8-4-2: FIRE CODE VIOLATIONS:
   A.   Violations, Penalties And Compliance: Violations of the fire prevention code shall be punished as provided in section 1-3-1 of the municipal code; provided that the application of the above penalty shall not be held to prevent the enforced removal of the violations. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within an allotted time required by the fire chief and/or the person in charge of the fire prevention bureau.
   B.   Citations: A citation will be issued to any person charged with a violation of BOCA fire prevention code, section 110.0 entitled "Unsafe Conditions" or similar violations of other applicable regulations constituting the following citations:
      1.   Dangerous conditions liable to cause or contribute to the spread of fire in or on said premises or structure or endanger the occupants thereof.
      2.   Conditions which interfere with the efficiency or operation of any fire protection equipment and system.
      3.   Obstructions to or on fire escapes, stairs, passageways, doors, windows, which are liable to interfere with the egress of occupants or the operation of the fire department in case of fire.
      4.   Accumulations of dust or waste material in air conditioning or ventilating systems or grease in kitchen or other exhaust ducts.
      5.   Accumulations of grease on kitchen cooking equipment, or oil, grease or dirt upon, under or around any mechanical equipment.
      6.   Accumulations of rubbish, waste, paper, boxes, shavings or other combustible materials, or excessive storage of any combustible material.
      7.   Hazardous conditions arising from defective or improperly utilized or installed electrical wiring, equipment or appliances.
      8.   Hazardous conditions arising from defective or improperly installed equipment for handling or using combustible, explosive or otherwise hazardous materials.
      9.   Dangerous or unlawful amounts of combustible, explosive or otherwise hazardous materials.
      10.   All equipment, materials, processes or operations which are in violation of the provisions and intent of the documents of enforcement.
Violators will be informed of the violation by a citation issued by enforcement personnel of the village detailing the nature of the violation(s) in substantially the form stated below, and ordered to correct the violation(s) within thirty (30) days. If the violation is determined to be an immediate threat to the safety of the inhabitant(s) of a structure, the correction shall be completed within the time stated in the notice provided when the inspection is made.
All violations documented herein shall be corrected within thirty (30) days of this notice. Failure to take corrective action will result in the issuance of a "Local Ordinance Citation" and the violator may be subject to a fine of not less than twenty five dollars ($25.00) for each uncorrected violation.
 
   C.   Prosecution Of Violations:
      1.   Any person charged with a violation of BOCA section 110.0 entitled "Unsafe Conditions" or similar violations of other applicable regulations, a citation issued by enforcement personnel of the village, detailing the nature of the violation, may avoid prosecution by exhibiting proof of correction of the condition or compliance with the ordinance stated to have been violated and the payment of not less than twenty five dollars ($25.00) within ten (10) days of issuance, or fifty dollars ($50.00) after ten (10) days, but within thirty (30) days before the hearing date, to the village clerk or his designee.
      2.   Absent the failure to satisfy the citation, the person charged shall appear at the place, time and date designated on the citation and the executive head of the department or his designee shall thereupon conduct a hearing. After the hearing by the executive head of the department, the executive head shall take the following action:
         a.   Dismiss the citation; or
         b.   Find that there was probable cause for the issuance of the citation and that the original amount for the commission of such violation shall remain the same; or
         c.   In the event the violator has not corrected the violation and/or paid the penalty within the time established by the enforcement personnel, proceed to institute appropriate proceedings against the violator in the circuit court of Cook County, Illinois.
      3.   Violations requiring more than thirty (30) days to correct shall be documented with a plan of correction, drafted by the fire inspector. Such plans of correction shall detail the nature of the violation and identify the time period within which compliance shall be completed. Plans of correction will bear the signature of the building owner and/or manager and the fire inspector. Compliance with plans of correction will be monitored by the fire inspector. (Ord.
