A. Required:
1. The ownership or interest in any structure or building shall not be sold or transferred unless the seller furnishes the buyer with a certificate of compliance based on an inspection of said structure made within four (4) months of the date of any contract for sale or transfer of ownership or interest.
2. The certificate of compliance must state that the building complies with all applicable building and zoning regulations of the Village, or if the property is in noncompliance with the building and/or zoning regulations, the nature of that noncompliance.
3. By virtue of the issuance of said certificate of compliance, the Village does not guarantee the subject premises to be free from mechanical, electrical or structural defects, and the Village shall not be responsible or liable for any claims arising from such defects.
4. The inspection fee for such inspection made at the request of any buyer, seller or real estate broker shall be at the rate schedule set forth in subsection 8-2-3I of this title, payable in advance at the time of the request.
A single reinspection to assure compliance is included in the initial fee. If an additional reinspection is required, the fee shall be forty dollars ($40.00) per inspection.
B. Temporary Certificate: In the event that a certificate of compliance is not issued after completion of the inspection by the Department of Health and Safety, an owner may sell, transfer or convey improved real property upon issuance of a temporary certificate of compliance upon completion of the following subsections:
1. Deposit of one hundred dollars ($100.00) with the Village as a prepaid reinspection fee after the abatement of all violations;
2. Written confirmation on the part of the buyer, grantee or transferee certifying to the Village that such buyer, grantee or transferee has assumed the obligation to abate all violations of the Municipal Code within four (4) months of the issuance of the temporary certificate of compliance. C. Violation; Penalty: A person who participates in a sale or transfer in violation of this section as a seller, buyer or agent shall be fined no less than one hundred dollars ($100.00) and no more than one thousand dollars ($1,000.00) for such offense. (Ord. O-17-01, 3-26-2001)
