No person shall sell, keep, expose for sale, loan, give away, be possessed of, or discharge anywhere in the village any toy pistol, toy gun, toy cannon, blank cartridge, fireworks, firecrackers, torpedoes, bombs, squibs, rockets, spin wheels, fire balloons, Roman candles, detonating canes, ammunition, or any substance or articles of an explosive nature designed or intended to be used as fireworks; provided, however, that the council may issue a permit for consumer fireworks displays and for pyrotechnic displays, as such terms are defined in the fireworks use act 1 and the pyrotechnic distributor and operator licensing act 2 , as further designated hereinafter.
A. Pyrotechnic Displays: Pyrotechnic displays shall be permitted in the village of Forest Park only on public property owned and operated by the Forest Park park district. No indoor pyrotechnic display shall be permitted in the village of Forest Park. No pyrotechnic displays shall be permitted unless the park district or its agent has obtained a pyrotechnic display permit from the village of Forest Park. No such pyrotechnic display permit shall be issued by the village of Forest Park unless the applicant meets the following minimum requirements:
1. The applicant must submit a written application for a village permit at least fifteen (15) days in advance of the date of the pyrotechnic display.
2. The pyrotechnic display service must be provided by a licensed pyrotechnic distributor, and the display must be conducted by a licensed lead pyrotechnic operator.
3. The applicant must provide proof of liability insurance in a sum not less than one million dollars ($1,000,000.00) with an insurance company authorized to do business in Illinois.
4. The fire chief of the village, or his/her designee, must inspect the display site and ensure that the display can be performed in full compliance with the NFPA standards adopted and amended by the office of the state fire marshal, in its rules, part 235, for the type of pyrotechnic display to be performed. The fire chief shall be required to sign the village display permit, prior to its issuance.
Such village pyrotechnic display permits shall not be transferable to another person or entity.
B. Consumer Fireworks Displays Prohibited: No consumer fireworks display shall be permitted in the village of Forest Park, unless otherwise conducted pursuant to subsection A of this section, which regulates pyrotechnic displays. (Ord. O-31-06, 5-22-2006)
