3-3-11: MINORS:
   A.   Employment: No person under the age of twenty one (21) years shall sell, draw or mix or be permitted to sell, draw or mix any alcoholic liquor in any premises licensed for the sale or dispensing of alcoholic liquor under this chapter. The provisions of this subsection shall not be construed to prevent the employment of persons who are at least eighteen (18) years of age as waiters or waitresses in restaurants, hotels, or motels for the purpose of serving food and alcoholic liquor on the licensed premises.    B.   Sales To:
      1.   No licensee or any officer, associate, member, representative, agent or employee of any licensee shall sell, give or deliver alcoholic liquor to any person under the age of twenty one (21) years or to any intoxicated person or to any person known to him to be under legal disability or in need of mental treatment.
      2.   No person, after purchasing or otherwise obtaining alcoholic liquor, shall give or deliver alcoholic liquor to another person under the age of twenty one (21) years except in the performance of a religious ceremony or service.
   C.   Purchases By: No person to whom the sale, gift or delivery of alcoholic liquor is prohibited shall consume, purchase or accept alcoholic liquor or have alcoholic liquor in his possession. This subsection shall not apply to the dispensing or consumption of alcoholic liquor by a person under twenty one (21) years of age in the performance of a religious ceremony or service, or the consumption by a person under twenty one (21) years of age under the direct supervision of the parent, or parents or person in loco parentis in the privacy of a home.    D.   Misrepresentation Of Age: It shall be unlawful for any minor to misrepresent his age for the purpose of purchasing, obtaining or consuming alcoholic liquor in any place within the village where alcoholic liquor is sold or offered for consumption. (Ord. O-29-00, 7-10-2000)
   E.   Presence Of Minors Prohibited:
      1.   Unlawful: It shall be unlawful for the holder of a liquor license, his agent or employee, to permit any person under the age of twenty one (21), except waiters and waitresses, to be in or remain in any room or place in which alcoholic liquor (inclusive of beer and/or wine) is served, within an establishment whose principal business is the sale of alcoholic liquor.
      2.   Exceptions:
         a.   This subsection shall not apply to any minor who is accompanied by his parent(s) or legal guardian(s); however, the presence of such parent or guardian does not grant the right or privilege to any person under the age of twenty one (21) to consume or possess any type of alcoholic liquor.
         b.   This subsection shall not apply to any restaurant or other establishment whose principal business activity is not the sale of alcoholic liquor. However, such exception shall not apply to restaurants or other establishments wherein the kitchen/food preparation area is closed and food is no longer being consumed or offered for sale and the premises are dispensing alcoholic liquor in any room or place in the premises.
