12-3-6-1: PROPOSED LANDMARK:
   A.   Manner Of Consent: In the event that the commission receives a completed application from someone other than the owner of record of the property being nominated, the owner of record shall immediately be sent written notice of same in accordance with subsection 12-1-4C1a of this title. If a site is owned by more than one owner of record, each owner will be notified of the application and must submit a signed consent form for the site. The forms for such consent shall be prepared in a manner that enables the village to verify whether the person submitting the consent is the owner of record, while keeping the owner's name separate from the owner's indication of whether or not the owner consents to the designation. If a site is owned by only one owner of record and that owner is the applicant, the owner's consent will be presumed and the commission shall proceed with the public hearing process. (Ord.    B.   Effect Of Consent: Once the owner of record consents to a building being designated as a landmark, and said designation is approved by the village council, said building shall be subject to the rules and regulations set forth in this title. Said designation shall attach to the property and subsequent owners shall be subject to the rules and regulations of this chapter. The ordinance approving such designation shall be recorded, as provided in section 12-3-5 of this chapter. An owner selling such a property shall also have an affirmative duty to inform a potential purchaser of said designation. Failure of an owner to so inform a purchaser shall not be considered as a reason to remove said designation from said building. A list of properties so designated shall be maintained at village hall for public review. (Ord. O-1-06, 1-9-2006)
