§ 98.06 REGISTRATION AND RIGHT-OF- WAY OCCUPANCY.
   (A)   Right-of-way occupancy. No privately owned structure, sign, or improvement shall be located within a public right-of-way with the exception of:
      (1)   A mailbox for the use of receiving mail from the United States Postal Service or a newspaper delivery;
      (2)   Private driveways, driveway culverts, and existing boulevard plantings or gardens, provided the city is not required to maintain these site improvements;
      (3)   The city may, at its discretion, conduct maintenance on private improvements in the public right-of-way in order to address issues related to safety and proper functioning of public infrastructure; and/or
      (4)   Structures used by a telecommunications right-of-way user to support small wireless facilities.
   (B)   Registration. Each person who occupies or uses, or seeks to occupy or use, the right-of-way or place any equipment or facilities in or on the right-of-way, including persons with installation and maintenance responsibilities by lease, sublease, or assignment, must register with the city. Registration will consist of providing application information.
   (C)   Registration prior to work. No person shall construct, install, repair, remove, relocate, or perform any other work, or use any facilities or any part thereof, within any right-of-way without first being registered with the city. Such registration shall be made on a form provided by the city and shall be accompanied by the required registration fee. A person seeking to install a new wireless support structure for the siting of a small wireless facility in a right-of-way shall comply with all requirements for such facilities, including obtaining a Conditional Use Permit if necessary, found in Chapter 153 of this code.
