ORDINANCE NO. 557
AN ORDINANCE ADOPTING A CITY CODE FOR THE CITY OF FOREST LAKE AND SETTING FORTH A SUMMARY THEREOF
   The City Council of the City of Forest Lake, Washington County, Minnesota hereby ordains as follows:
   ADOPTION OF CITY CODE
   Pursuant to M. S. §§ 415.02 and 415.021, the City Council of the City of Forest Lake hereby adopts the City Code for the City of Forest Lake which is a codification of all ordinances of the city of a permanent and general nature as revised, codified, rearranged, renumbered and consolidated into component codes, titles, chapters and sections to be known and designated as the “City Code” or "Forest Lake Code" in form and as on file in the office of the City Clerk on the 13th day of November, 2006.
   PURPOSE
   The City Code is adopted to promote the public health, safety and general welfare of the City of Forest Lake and its people.
   AREA OF APPLICATION
   The City Code is applicable to and enforceable in all of the area within the corporate boundaries of the city as presently established or as amended by ordinance, annexation or other legal actions at a future time.
   ADMINISTRATION
   The City Code shall be administered by the City Council of the City of Forest Lake and/or its designees, including the City Administrator and the Community Development Director.

   GENERAL REPEALER
   Any ordinance of a permanent and general nature heretofore existing excluding any such ordinance passed on or after July 1, 2006 and whether adopted by the City of Forest Lake or the Town of Forest Lake prior to its annexation to the City of Forest Lake pertaining to the subjects treated in the Forest Lake Code shall be deemed repealed from and after the effective date of this Ordinance, except as they are included and reordained in whole or in part in the Forest Lake Code; provided, this repeal shall not affect any offense committed or penalty incurred or any right established prior to the effective date of this Ordinance, nor shall this repeal affect the provisions of ordinances levying taxes, appropriating money, annexing territory, establishing franchises, authorizing public improvements, authorizing the issuance of bonds or borrowing of money, authorizing the purchase or sale of real or personal property, zoning or rezoning of property, granting or accepting easements, plat or dedication of land to public use, vacating or setting the boundaries of streets or other public places; nor shall this repeal affect any other ordinance of a temporary or special nature or pertaining to subjects not contained in or covered by the Forest Lake Code. All fees established by ordinance whether codified in this Code or otherwise and presently in effect shall remain in effect unless amended in this Code or until an ordinance adopting a fee schedule is adopted or amended.
   PENALTY
   Section 1.   The City Code establishes certain administrative penalties and penalty procedures for violations of specific provisions of the Code to provide the public and the City with an informal, cost effective and expeditious alternative to traditional criminal charges for violations of certain provisions of the Code. The procedures are intended to be voluntary on the part of those who have been charged with those offenses.
   Section 2.   Any person, firm or corporation who violates any provision of the Code for which another penalty is not specifically provided shall, upon conviction, be guilty of a misdemeanor. The penalty which may be imposed for any crime which is a misdemeanor under the City Code, including Minnesota Statutes specifically adopted by reference, shall be a sentence of not more than 90 days or a fine of not more than $1,000.00 or both.
   Section 3.   Any person, firm or corporation who violates any provision of the City Code, including Minnesota Statutes specifically adopted by reference, which are designated to be a petty misdemeanor shall, upon conviction, be guilty of a petty misdemeanor. The penalty which may be imposed for any petty offense which is a petty misdemeanor shall be a sentence of a fine of not more than $300.00.
   Section 4.   In either of the case of a misdemeanor or a petty misdemeanor, the costs of prosecution may be added.
   Section 5.   In addition to any other penalties provided for in the City Code, if any person, firm or corporation fails to comply with any provisions of the City Code, the Council or any City Official designated by it may institute appropriate proceedings at law or at equity to restrain, correct or abate the violation.
   EFFECTIVE DATES
   This Ordinance shall be effective upon its passage and publication in the legal newspaper of the City of Forest Lake.
   PUBLICATION
   This Ordinance adopting the Forest Lake Code shall be a sufficient publication of any ordinance included in it and not previously published in the city’s official newspaper. The Clerk of the City shall cause a substantial quantity of the Forest Lake Code to be printed for general distribution to the public at actual cost. A printed copy of the entire City Code shall be available for inspection by any person during regular office hours at the City Administrative Offices, the City Department of Community Development and the City Library. The official copy of this Code of Ordinances shall be marked and kept in the office of the City Clerk.
   EVIDENCE OF THE LAW OF THE CITY
   The Forest Lake Code is declared to be prima facie evidence of the law of the City of Forest Lake and shall be received into evidence as provided by Minnesota Statutes by the Courts of the State of Minnesota.
   Adopted by the City Council of the City of Forest Lake this 27th day of November, 2006.
