§ 53.06 STREET LIGHTING RATES AND FEES.
   (A)   The City Council shall by ordinance adopt a street lighting service charge rate structure to defray the costs of the establishment, construction, repair, replacement, maintenance, enlargement and improvement of the street lighting system. The City Council shall have the continuing right to amend the rates if the established rates are not sufficient to cover the costs of the street lighting system.
   (B)   A statement of charges shall be rendered quarterly in January, April, July and October of each year on parcels receiving statements for sewer and water charges and annually in January of each year on parcels not receiving such statements. A penalty of 3% of the balance of such account remaining unpaid 30 days after the billing date shall be added to the account. Each year at the September meeting of the City Council, the Clerk shall submit a full report of street light utility accounts that are delinquent. The Council shall then determine in each case to authorize the necessary proceedings to collect the same by certifying the delinquent amount and penalty to the County Auditor for collection along with real estate taxes, or by other methods, with costs and interest as the Council may see fit.
   (C)   It shall be the responsibility of the property owner to pay for all street light utility charges.
