§ 53.04 EXISTING SUBDIVISIONS WITHOUT A STREET LIGHT SYSTEM.
   (A)   In all existing subdivisions without a street lighting system, the City Council, upon a petition of at least 35% of the property owners in the subdivision, or upon its own initiative, shall determine the streets, parks or other public and private areas on which the city will install and operate a street lighting system.
   (B)   Before any service is furnished, the City Council shall schedule a hearing pursuant to the provisions of M.S. § 429, as it may be amended from time to time, at which time the City Council will consider the installation of the street lighting system.
   (C)   The city may pay a portion of the costs of installation of the street lighting system in an amount as the City Council may determine from its street lighting utility fund. In the event the Council elects not to pay some or all of the installation costs, the unpaid portion shall be assessed against the benefitted property owners as a public improvement.
