1329.04 ABATEMENT BY THE VILLAGE.
   Should the nuisance not be abated by the expiration of the time stated in the notice or by such additional time as the Mayor or Hearing Board may provide per Section 1329.03, the Mayor shall have the right to cause the premises to be entered in or upon to abate the nuisance, or to institute the appropriate action for prosecution, or both. This remedy shall be in addition to the penalty provided in Section 1329.99. During the abatement of the nuisance, the Mayor may cause actions to whatever extent may be necessary to complete the abatement and if practicable, to sell or salvage any material derived in such abatement. The Mayor may cause to be sold the same at a private or public sale at the best price obtainable and shall keep an account of the proceeds thereof. Such proceeds, if any, shall be deposited in the General Fund of the Village and any difference between the amount received and the cost of abatement shall be levied as an assessment against the property by the Village Council, certified to the County Auditor and collected as any other assessment by the Village. Should the proceeds of the sale of salvaged material exceed the cost of abatement, the surplus shall be paid to the owner(s) of the premises when their proper claim is established. The Mayor, abating the nuisance, may call upon the service departments of the Village, the Health Department of the County, or private contractors.
