§ 46-117  ABATEMENT OF DRAINAGE NUISANCE.
   (a)   Any surface, roof or sump drainage which flows into or across any adjacent premises, or buildings, so as to create a structural hazard, a health hazard or a nuisance to the owners or occupants of the adjacent premises, shall be abated by the owners of the improperly drained area, who shall cause the drainage to be disposed of in a manner acceptable to the Plumbing Official.
   (b)   Should any surface, roof or sump pump drainage flow into, onto or across a public thoroughfare, e.g., sidewalk, street or alley, and create a nuisance and/or hazard to persons using the thoroughfare or cause stoppage or undue maintenance of public drainage systems, the owner of the improperly drained area shall abate the nuisance in accordance with orders issued by the Plumbing Official.
