§ 37-2.3  SAME — NOTIFICATION BY DIRECTOR TO CORRECT HAZARDOUS CONDITIONS; WORK PERFORMED BY CITY.
   Upon the findings of the Director of Public Works and Utilities or his or her designee that the condition of any public right-of-way, due to the existence of a utility installation or repair constitutes an immediate hazard and that danger exists to persons and/or property which requires immediate action to alleviate the hazard and danger, the Director of Public Works and Utilities or his or her designee shall attempt to notify the owner or person in charge of the utility installation that the condition exists, and advising that, if the condition is not corrected within three days, that the City will commence the work necessary to correct the effect and bill the cost of the work performed by the City to the utility, person and/or company involved. The attempted notification and repair will not operate to relieve the utility, person or company of primary responsibility and liability in causing or allowing the defect in the first place.
