§ 37-2.1  PERSONS OR COMPANIES INSTALLING AND/OR MAINTAINING UTILITY LINES WITHIN PUBLIC RIGHTS-OF-WAY — TO INDEMNIFY CITY AGAINST COSTS AND DAMAGES.
   Any person and/or company in the work of laying down, repairing, retaining in place, relaying or continuing gas pipes, electrical, cable communications, communications and/or fiber optics/telecommunications lines along, across, under, over and through any and all streets, lanes, alleys and sidewalks, and public grounds of the City, and in digging or other installation or repair work necessary on the pipes and/or lines shall take care not to unnecessarily obstruct or injure the streets, lanes, alleys, sidewalks or public grounds and shall with reasonable diligence restore the streets, lanes, alleys, sidewalks or public grounds to as good a state of repair and condition as the same was before disturbed by the person and/or company, and shall in all respects fully indemnify and save harmless the City from and against all damages and costs which the City shall be put to or sustain by reason of the installation or repair work, or any claim, damages, demands or causes of action arising out of the utility’s use of the public right-of-way.
