521.05  LITTERING AND DEPOSIT OF GARBAGE, RUBBISH, JUNK, ETC.
   (a)   No person shall, without lawful authority, place, drop, discard, throw or dispose of in any manner upon any public property or upon the premises of another, any paper, trash, garbage, waste, rubbish, refuse, junk, ashes, cans, bottles, cartons, boxes, automobile parts, furniture, glass or any substance or material which is or may become noxious, offensive, injurious or dangerous to the public health, comfort or safety.
   (b)   No person shall cause or allow paper, trash, garbage, waste, rubbish, refuse, junk, ashes, cans, bottles, cartons, boxes, automobile parts, furniture, glass or any other noxious or offensive materials or substances to be collected or remain in any place to the damage or prejudice of others or of the public, or unlawfully obstruct, impede, divert, corrupt or render unwholesome or impure, any natural watercourse.

   (c)   No person owning, occupying or possessing any real property in the City shall cause or place or allow to be caused or placed any paper, trash, garbage, waste, rubbish, refuse, junk or offensive materials or substances or any receptacles containing any paper, trash, garbage, waste, rubbish, refuse, junk, ashes, cans, bottles, cartons, boxes, automobile parts, furniture, glass or offensive materials or substances in a front yard or in a side yard adjacent to a public street except after 5:00p.m. the day before scheduled collection. Empty receptacles must be returned to storage no later than 6:00p.m. the day after collection for the premises. Container storage provisions shall be in accordance with Section 1325.05(b).

   (d)   (1)   Whoever violates subsection (a) or subsection (b) hereof is guilty of a minor misdemeanor on a first offense.  If the offender has previously been convicted of a violation of subsection (a) or (b) hereof, whoever violates subsection (a) or (b) hereof is guilty of a misdemeanor of the fourth degree.
      (2)   Whoever violates subsection (c) hereof is guilty of a minor misdemeanor.

   (e)   Whoever violates this section, in addition to the penalty imposed pursuant to subsection (d) hereof, shall be liable for the removal or cost of removal of all paper, trash, garbage, waste, rubbish, refuse, junk, ashes, cans, bottles, cartons, boxes, automobile parts, furniture, glass or other substance or material.
