(A) Prohibiting sale of fireworks; exception. It shall be unlawful for any person to sell, trade, exchange or give away, or offer to sell, trade, exchange or give away any fireworks, firecrackers, cannon crackers, torpedoes or other explosive pyrotechnics, except during the period between June 26 through July 5 and December 29 through December 31 inclusive of each year, during which period, it shall be legal to sell said articles. Any person proposing to offer fireworks for sale shall be subject to the provisions of this section relating to business licenses. Fireworks may not be sold before 9:00 a.m. or after 11:00 p.m. on permissible sale dates.

(B) Regulations on use.
(1) It shall be unlawful to discharge or cause to be discharged any fireworks, firecrackers, cannon crackers, torpedoes or other explosive pyrotechnics, except during the period between June 26 through July 5 and December 29 through December 31 inclusive of each year, during which period, it shall be legal to discharge said articles, subject to the terms of this section.
(2) It shall be unlawful for any individual, firm, partnership or corporation to discharge or cause to be discharged any fireworks within 100 feet of a firework sales location, from inside or toward a motor vehicle, or in the vicinity of another person or group of people or any animal in a manner likely to expose them to risk of injury.
(3) Fireworks may not be discharged before 9:00 a.m. or after 12:00 a.m. on dates when use is permitted.
(C) Supervised public display of fireworks. The state’s Fire Marshal and the Town Council shall have the power, under reasonable rules and regulations adopted by it, to grant permits for supervised public displays of fireworks. Every such display shall be handled by a competent operator to be approved by the state’s Fire Marshal or by the Town Council and shall be of such character and so located, discharged or fired so as, in the opinion of the Chief of the Fire Department or such other officer as may be designated by the Town Council, after proper inspection, shall not be hazardous to prope1iy or endanger any person or animal. Applications for permits to conduct public fireworks displays shall be made pursuant to Chapter 111 of this code of ordinances. After a permit is granted, sales, possession, use and distribution of fireworks for such display shall be lawful for the limited purpose of said display only. No permit granted under this division (C) shall be transferrable.
(D) Where section does not apply. Nothing in this section shall be construed to prohibit the sale of any kind of fireworks to a person holding a permit from the town for a display covered by such permit, or the use of fireworks by railroads or other construction or transportation agencies for signal purposes or illumination, or when used in quarrying, blasting or other industrial use, or the sale or use of blank cartridges for show or theater, or for signal or ceremonial purposes in athletics, or for use by military organizations or organizations composed of veterans of the United States military.
