557.03 WRITTEN NOTICE TO DESTROY WEEDS; REMOVE LITTER.
(a) The Superintendent of Building Inspection and Zoning or Designee upon information that noxious weeks, grass or other types of vegetation have not been cut as required by Section 557.01 shall issue a notice of violation to the owner, lessee, agent or tenant having charge of or responsibility for maintenance of the lots or lands by personal delivery or certified mail, return receipt requested, that such growth must be cut within five days after service of notice.
(b) The Superintendent of Building Inspection and Zoning or designee, upon information that litter has been allowed to accumulate in violation of Section 557.02 shall issue a notice of violation to the owner and, if different, upon the lessee, agent or tenant having charge of or responsibility for maintenance of lots or lands by personal delivery or certified mail, return receipt requested, that such litter must be collected and removed within five days after service of the notice.
(c) Notice shall be sent to the address of the owner of record as stated on the most current Butler County Auditor’s records or to any lessee, agent or tenant at their last known address. If certified mail is not delivered, it shall be resent by regular mail and is presumed delivered three days thereafter or may be posted in a conspicuous place on the premises.
(d) Every notice either to cut weeds, grass or other vegetation or remove litter shall state that if the notice is not complied with within the time limit provided therein, in addition to the penalty provided in Section 557.99, costs incurred by the Municipality in cutting such growth or removing such litter including administrative and supervisory costs as stated in Section 557.05 shall be entered upon the tax duplicate and shall be a lien upon such lands.
