15-2008:   SUSPENSION OR REVOCATION OF LICENSE:
   A.   Vehicle License:
      1.   The license for any vehicle to operate as a taxicab in the City may be revoked by the City for the following reasons:
         a.   For failure of the driver to be properly licensed and maintain said license, as provided by the provisions of this chapter.
         b.   Failure to maintain vehicle in a safe operating and sanitary condition.
         c.   Whenever it shall be determined upon investigation that the license issued hereunder has been obtained by misrepresentations, fraud or that the owner has permitted such taxicab to be used for immoral or unlawful purposes.
      2.   When said license has been cancelled, no license thereafter shall be issued to such owner for a period of twelve (12) months.
   B.   Operator's License:
      1.   Basis For Suspension Or Revocation: A taxi operator's license may be suspended by the Chief of Police for a period not to exceed ninety (90) days or revoked entirely for any of the following reasons:
         a.   For operating a taxicab while under the influence of liquor or any controlled or dangerous substance.
         b.   For leaving the scene of an accident.
         c.   For failure to make a full report of an accident to the Police Department.
         d.   For loaning or permitting any person to use his license.
         e.   Upon conviction of a third major traffic violation during one license year. ("Any major traffic violation" is hereby defined to be: speeding, reckless driving, nonobservance of lights and signs, making left or U-turn where not permitted, driving on wrong side of street.)
         f.   Upon conviction of violation of any felony under Federal or State law.
         g.   For violation of this chapter or any traffic ordinance of the City.
         h.   For the purchase and/or delivery of any controlled and dangerous substance, alcoholic, intoxicating beverage and/or low point beer from any place of sale, purchase or distribution to any customer, fare, person or establishment, in violation of State Statute or ABLE Commission regulations.
         i.   For using a privately owned, unlicensed, noncommercial vehicle to conduct such business.
         j.   Revocation or suspension of the person's State driver's license.
      2.   Report Of Revocation Or Suspension: Whenever a taxi operator's license is suspended or revoked, the Chief of Police shall take up the taxi operator's license and forward it to the City Clerk together with a full report of the reasons for such revocation or suspension.
      3.   Term Of Revocation: No taxi driver whose license has been revoked shall be eligible to receive a new license until twelve (12) months (1 year) from the date of such revocation.
      4.   Appeal: It is provided that in the event a taxi operator's license is suspended or revoked by the Chief of Police, such driver may appeal to the City Council or District Court and be given an opportunity to show why the license should not be suspended or revoked. (Ord. 12-11-3, 11-5-2012)
