14-112:   SETTING FEES FOR PERMITS TO CUT STREETS FOR INSTALLATION OF UTILITIES:
   A.   No contractor shall cut, invade or damage any street, bar ditch, curb or sidewalk without first obtaining a permit to do so from the City.
   B.   The permit required shall be obtained from the Office of the City Clerk of the City.
   C.   The permit shall be in writing and shall specifically identify the street, bar ditch, curb or sidewalk that is to be cut or invaded, and it shall be a criminal offense to invade, cut or damage any street, curb, bar ditch or sidewalk without first obtaining the written permit.
   D.   Prior to the issuance of the permit, the City Clerk shall collect a fee for such permit as set by the City Council by motion or resolution:
      1.   Cutting concrete or asphalt street;
      2.   Cutting dirt or gravel street;
      3.   Cutting concrete or asphalt sidewalk;
      4.   Cutting or invading concrete curb; or
      5.   Cutting or invading bar ditch.
   E.   Any contractor or citizen of the City shall have the right to request a waiver of fees above set forth by applying to the City Council of the City and upon receipt of a favorable determination by the Council. (Ord. 85-11-2, 11-2-1985)
