1751.04 DEFINITIONS.
   The following definitions shall apply in the interpretation and enforcement of this Residential Building and Property Maintenance Code:
   (a)   “Code Official” shall be the “Code Official” identified in the IPC, the person charged by the Mayor with the administration and enforcement of this Title Five, Building and Property Maintenance Code of the City of Euclid.
   (b)   “Condominium” means a form of real property ownership in which a declaration has been filed submitting the property to the condominium form of ownership per the Ohio Revised Code and under which each owner has an individual ownership interest in a unit with right to exclusive possession of that unit and an undivided ownership with the other unit owners in the common elements of the condominium property.
   (c)   “Firewood” means the cut and/or split trunk or branches of fir trees stored or used for fuel in afire with the purpose of heating a dwelling unit, operating a wood stove or fireplace, or for outdoor recreation or cooking.
   (d)   “IPC” means the International Property Maintenance Code.
   (e)   “Multiple dwelling” means a building containing three or more dwelling units or one or more dwelling units if the building contains a use other than a dwelling use, For the purpose of applying this definition, any building which is being operated as a rooming house pursuant to a valid City license shall be classified as a multiple dwelling.
   (f)   “Rental” means any residential dwelling unit occupied by a person who is not the owner of record regardless of whether or not such person pays money or other valuable consideration therefore.
   (g)   “Tenant” as used in this Code and in the IPC includes any person, corporation, partnership or group, whether or not the legal owner of record, occupying a building or portion thereof as a unit. The meaning of “tenant” shall include but not be limited to occupancy by any person having any familial or personal relationship with the owner.
   (h)   “Two-family dwelling” means a building containing two dwelling units which may be arranged side-by-side, one above the other or in an alternative arrangement.
   (i)   “Vacant” means that no person actually resides in any part of the building or that no person conducts a lawful business in any part of the building.
   (j)   “Violation” means failure or refusal to follow or comply with any provision of this Building and Housing Code or with any requirement or order issued under the provisions of this Code.
