1739.08 SEALING OF COMBUSTION DEVICE.
   The Commissioner of Buildings may order that the use of a combustion device be discontinued and may seal such device whenever:
   (a)   An order requiring abatement of a violation is not complied with within ten days after service of such order. Except in cases of emergency, an order requiring abatement of a violation shall be preceded by a notice as provided in Section 1739.06.
   (b)   In the case of movable equipment such as a team rollers, steam derricks, pile drivers, locomotive cranes or tar kettles, but not including locomotives or steamboats, immediate correction of a condition causing a violation of this chapter is not made by the operator of such equipment when ordered to do so by the Commissioner or his or her authorized representative.
   (c)   Operation of the combustion device is deemed hazardous to persons or property. In cases of emergency, the combustion device may be sealed without notice; in other cases written notice shall be given with a time limit set for compliance.
   (d)   Repairs or alterations deemed necessary for operation of the device in conformity with this chapter are not made within the time limit specified in the notice or within a time limit extension.
   (e)   Required fees are not paid within thirty days of the date of an annual inspection.
