135.01 DIRECTOR OF SERVICE.
   The Director of Service shall perform such duties and functions in connection with the public service of the City as the Mayor may direct or as Council may specifically provide by ordinance.
   Under the authority of the Mayor, he or she may establish such subdepartments as may be necessary and determine the number of superintendents, foremen, deputies, inspectors, clerks, mechanics, truck drivers, equipment handlers, helpers, guards, skilled and common laborers and other persons necessary for the execution of the public work and public service and the performance of the functions of the Department.

135.02 ENGINEERING SERVICES.
   When approved by the Mayor, the Administrative Director and/or the Service Director are hereby authorized and empowered to employ or engage the professional services of a registered engineer to perform, in connection with the construction or installation of any public improvement, the various professional services required for such studies, including planning, estimates, conferences, general and detail plans and specifications, proposals, surveys, profiles, inspection, supervision, negotiations, maps, tests and such other general and special engineering services as may be required. Compensation may be paid for such professional engineering services on the basis of a percentage of the entire cost of construction in accordance with the fee schedule recommended by the Ohio Society of Professional Engineers contained in their Code of Professional Practice for Professional Engineering Services. All other fees shall be in accordance with the Code of Professional Practice, the current edition, by the Ohio Society of Professional Engineers. All fees are payable in such installments as the Administrative Director or the Service Director may authorize, but based upon the progress of the project. The engineering services shall be engaged by written agreement in a form approved by the Director of Law. The cost of any special engineering services shall be added to and be a part of the cost of the public improvement for which such services are obtained and the Director of Finance is hereby authorized and empowered to pay for the cost of such engineering services upon the written requisition of the Administrative Director or the Service Director and to charge the same to the cost of the public improvement. In the determination of the cost of the public improvement, no credit shall be made for the cost of land, right of way or compensation for or damage to property. The drawings and specifications, together with all documents, tracings and field notes, shall be and remain the property of the City.

135.03 BUREAU OF EROSION AND FLOOD CONTROL IN DIVISION OF ENGINEERING.
   There shall be a Bureau of Erosion and Flood Control within the Division of Engineering under the direct supervision of the Director of Service, whose responsibility it shall be to exercise control over erosion and flood problems in the City and to pursue whatever steps are necessary to control and alleviate such conditions to the limit allowed by law. The Director of Service shall provide information to the residents of the City concerning flood control measures and shall be responsible to advise anyone concerned with flood control measures.

135.04 SERVICE DIRECTOR AS PLATTING COMMISSIONER.
   The Service Director is designated and appointed as the Platting Commissioner of the City. The Director shall provide regulations governing the platting of all lands in order to require all streets and alleys to be the proper width and to be coterminous with adjoining streets and alleys. The Platting Commissioner shall, if plats are prepared and submitted in accordance with the rules as prescribed by him or her, endorse his or her written approval thereon and they shall be submitted to Council for approval or disapproval. No plat shall be entitled to record in the Recorder's Office of Cuyahoga County without such written approvals so endorsed thereon. The regulations provided shall be effective, except that in any case of conflict with any provision in the ordinances of the City, such provision in the ordinances of the City shall be prevailing and controlling.

135.05 DEPOSITS REQUIRED FOR REVIEW, INSPECTION AND APPROVAL SERVICES OF CITY ENGINEER AND PROFESSIONAL CONSULTANTS.
   (a)   Consultant Service Charges. Whenever an applicant makes an application or presents a request or proposal to the City's Building Commissioner, the Service Director, the Planning Commission or Council requiring any review or inspections and approval by the City's Engineer, Surveyor or other consultant, the following fees shall be deposited with the Finance Director to pay for such professional services as follows:

      (1)   Single and two-family residential lot construction.

         B.   Footer Inspection by Surveyor   $120.00
      (2)   Multi-family residential (three-family and up) lot construction.
         A.   Plan and site review and approval by Engineer   Hourly
         B.   Footer inspection by Surveyor   Hourly
      (3)   Commercial or industrial lot construction.
         A.   Plan and site review and approval by Engineer   Hourly
         B.   Footer inspection by Surveyor   Hourly
      (4)   Lot split or consolidation plat, plat and site review and approval by Engineer.
         A.   Three lots or less   $250.00
         B.   Four lots or more   Hourly
      (5)   Subdivision plat, plat and site review and approval by Engineer.   Hourly
      (6)   Vacation of public street, plat and site review and approval by Engineer.   Hourly
      (7)   Retention basins, plan, calculations and site review and approval by Engineer.   Hourly
      (8)   Hillside construction, plan and site review and approval by Engineer.   Hourly
      (9)   Excavation and grading, plan and site review and approval by Engineer.   Hourly
      (10)   Non-engineer field inspections   Hourly
      (11)   Any other professional consulting service required by ordinance or requested by the City's Building Commissioner, the Service Director, the Planning Commission or Council to assist with any official study or review   Hourly
   (b)   Payment or Deposit Required. Where the above indicated fee is specified as an amount under five hundred dollars ($500.00), the charge for such services shall be made and paid in the full amount of the fee before any permit or permission is issued. Where the fee is designated as “hourly” and is five hundred dollars ($500.00) or more, the service shall be rendered and charged at the prevailing contractual rates established for such professional services for the City and a deposit for such services shall be made and paid equivalent to the anticipated charge for such services as estimated by the Service Director before such services are performed. Where the actual charge for the service is finally determined, the Finance Director shall refund any difference over paid or bill any difference under paid by the applicant in accordance with the certification of the Service Director in that regard. Such estimated deposit amounts may be adjusted by the Service Director whenever in his or her opinion the original deposit will be less than 80% of the later anticipated final fee. Such charges so deposited with adjustments, if any, shall not be refunded under any circumstances, regardless of whether or not the applicant proceeds further with the related project. No application or request shall be granted or permit issued for any purpose unless and until all of the aforesaid mandatory deposits have been made and paid in full. Any application or request may be dismissed without prejudice for failure to make any such deposit in full within 30 days written notice from the Service Director.
   (c)   Special Accounts. The Director of Finance shall establish special accounts within the City's funds on behalf of the above-stated applicants, and upon authorization of the Service Director he or she shall pay to the City by way of reimbursement or directly to the person who rendered the consulting services from such special accounts. The Director of Finance shall furnish an accounting of charges to any such account at any reasonable time upon request of the applicant and upon final dispersal.
   (d)   The Service Director be and he or she is hereby authorized to contract or amend contracts with the City Engineer, other engineering, surveying, and other consulting professionals or professional firms to perform the professional services described in division (a) through (c) of this section and as the same may be amended on behalf of the City, and the payment for which services in such contract(s) shall not exceed the following charge and rate schedule:
      (1)   Single and Two-Family Residential Lot Construction:
         A.   Plan and site review and approval by Engineer   $350.00
         B.   Footer inspection by Surveyor   $120.00
      (2)   Lot split or consolidation plat, plat and site review and approval by Engineer involving three lots or less   $250.00
      (3)   Engineering services done at an hourly rate   $110.00/hour
      (4)   Surveying services done at an hourly rate   $ 80.00/hour
      (5)   Non-engineering field inspections   $ 39.00/hour
   The terms of said contract(s) shall be in such form as is approved by the Director of Law. Said contract(s) shall be kept on file in the office of the Service Director.
