ADOPTING ORDINANCE
ORDINANCE NUMBER 1142
An Ordinance Adopting the Codification Ordinance of the City of Emporia,
Kansas, Authorized by Ordinance No. 1089, Providing for the Repeal of Certain Other Ordinances not Included Therein; Excepting Certain Ordinances From Repeal; Saving Certain Accrued Rights and Liabilities; and Providing for a General Penalty for the Violation of Such Codified Ordinances.
Be it Ordained by the Governing Body of the City of Emporia, Kansas:
   Section 1. The codification of ordinances of the City of Emporia, Kansas, authorized by Ordinance No. 1089, and sections 12-3014 and 12-3015 of the Kansas Statutes Annotated, as set out in the following chapters, Chapters 1 to 28, inclusive, and entitled the "Code of the City of Emporia, Kansas, 1983," is hereby adopted and ordained as the "Code of the City of Emporia, Kansas, 1983."
   Section 2. All ordinances of a general and permanent nature of the City enacted by the Governing Body, adopted on final passage on or before December 31, 1982, and not included in such Code and continued in force by reference therein, are hereby repealed from and after the effective date of such Code.
   Section 3. That the repeal provided for in section 2 hereof shall not be construed to revive any ordinance or part thereof that has been repealed by a subsequent ordinance which is repealed by this ordinance.
   Section 4. Unless another penalty is expressly provided, a violation of any provision of such Code, or any provision of any rule or regulation adopted or issued pursuant thereto, shall be punished as provided in section 1-6 of such Code.
   Section 5. Any and all additions and amendments to such Code, when passed in such form as to indicate the intention of the City to make the same a part of such Code, shall be deemed to be incorporated in such Code, so that reference to such Code shall be understood and intended to include such additions and amendments.
   Section 6. That in case of the amendment of any section of such Code for which a penalty is not provided, the general penalty, as provided in section 4 of this ordinance and in section 1-6 of such Code, shall apply to the section as amended, or in case such amendment contains provisions for which a penalty, other than the aforementioned general penalty, is provided in another section in the same chapter, the penalty so provided in such other section shall be held to relate to the section so amended, unless such penalty is specifically repealed therein.
   Section 7. One copy of such Code shall be kept on file in the office of the City Clerk with the ordinance books of the City, and such copy shall    
   constitute an ordinance book, as provided in Section 12-3015 of the Kansas Statutes Annotated. It shall be the duty of the City Clerk, or someone authorized by the Clerk, to maintain such copy by inserting in their designated places all amendments and ordinances which indicate the intention of the Governing Body to make the same a part of such Code, when the same have been printed or reprinted in page form, and by extracting from such copy all provisions which are repealed by the Governing Body. This copy of such Code shall be available to all persons desiring to examine the same during regular business hours.
   Section 8. All ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
   Section 9. This ordinance shall take effect upon publication in the official City newspaper.
