   (a)   Effective January 1, 2019, the following non-bargaining positions shall be assigned to the designated paygrades and statuses, pursuant to the 2019 Salary Study.

   (b)   Paygrades and the Fair Labor Standards Act.
      (1)   Positions listed in paygrade B32 and lower are non-exempt in accordance with the Fair Labor Standards Act ("FLSA") and shall be compensated at an hourly rate.
      (2)   Positions listed in paygrade C41 and above are exempt in accordance with the FLSA and shall be compensated based on a standard forty hour week.
   (c)   Steps; Placement and Adjustment; Promotions.
      (1)   New employees should be hired at step minimum, but may be hired between steps 0-3. If the appointing authority desires to hire an employee at a step above step 3, it must be preapproved by the personnel placement committee, in accordance with Chapter 177 of the Elyria Codified Ordinances.
      (2)   Step adjustments are based upon years of service within that position. Employees shall receive one step increase per year up to midpoint, and one step increase every other year thereafter up to the maximum step.
      (3)   If an employee is initially hired into a step that surpasses his/her years of service in that position, said employee will remain at that step until his/her years of service align with the step placement.
      (4)   An employee who is promoted to a position in a higher pay grade shall either be placed in the same step within the promoted position's pay grade or be placed in the lowest step of the promoted position's pay grade that still results in a pay increase for said employee, whichever yields a smaller increase. The promoted employee shall continue to progress through the steps as set forth in division (c)(5) of this section.
      (5)   An employee who is demoted to a position in a lower pay grade shall be placed in the same step within the demoted position pay grade.
      (6)   If an appointing authority desires to promote said employee to a pay grade higher than that permitted by division (c)(4) of this section, said promotion shall be approved by the personnel placement committee.
