(a) The Board of Building Standards and Appeals shall determine the suitability of materials and types of construction and methods of installation, and shall provide for reasonable interpretations of the provisions of the Building Code, relevant to same.
(b) The Board shall hear appeals of persons aggrieved by the provisions of the Building Code or by decisions of the Chief Building Official, with the exception of proceedings pursuant to the provisions of Chapter 1391 of these Codified Ordinances, which exclusively govern condemnation and demolition proceedings.
(c) The Board shall aid the Chief Building Official, when requested, in the enforcement of the Building Code, as defined herein.
(d) The Board shall have the power to accept or reject plans when the same are presented for review by the Chief Building Official in accordance with this chapter.
(e) The Board shall provide for the current updating of the Building Code and may advise Council of the necessity for amending provisions of the Code.
(f) The Board shall vary the application of any provision of the Building Code, as defined in this chapter, to any particular case when, in its opinion, enforcement thereof would do manifest injustice or would be contrary to the spirit and purpose of the Code or the public interest.
(g) The Board shall determine any requirement for the strength or stability of any existing building or structure, or for the safety or health of the occupants thereof, not specifically covered by the Building Code or Chapter 1391 of the Elyria Codified Ordinances, or not readily interpretable from the provisions of the Code or Codified Ordinances.
(h) Nothing in this chapter shall be construed, for purposes of an appeal of a condemnation or demolition order pursuant to Chapter 1391 of the Elyria Codified Ordinances, as a conferral of jurisdiction upon the Board of Building Standards of Appeals.
