(a) A development impact fee is established for storm drainage for recovering part of the City's costs expended in building the South Elyria storm sewer outfall sewer. Said fee shall be on certain real estate parcels located within the service area of the South Elyria storm sewer and shall be in the amount of three thousand three hundred sixty dollars ($3,360) per acre, pro-rated for any portion thereof, for permits issued in 1991. The base rate per acre shall be increased by five percent annually, compounded on January 1 of each year thereafter.
(b) Said development impact fee shall be due only upon obtaining a building permit for new construction on said real estate parcels, except that no development impact fee is due if the real estate parcel is zoned COS when applying for the building permit. Said real estate parcels are listed within the service area of the South Elyria Storm Sewer District, are identified by permanent parcel numbers on a list which is on file in the City Engineer's office, and are designated as real estate parcels affected by the development impact fee for the South Elyria storm sewer outfall sewer. Said permanent parcel numbers were the numbers in use by the County of Lorain as of April 30, 1991.
