745.01 DEFINITIONS.
   As used in this chapter:
   (a)   "Rummage sale" means a transaction or a series of transactions by which is title or possession, or both, of more than twelve items of tangible personal property, consisting of miscellaneous articles of household goods, furniture, furnishings and personal effects, both used and new, are or are to be transferred for a consideration in any manner, whether absolutely or conditionally, whether for a price or rental, in money or by exchange, and by any means whatsoever.
   (b)   "Person" includes any natural person, firm, corporation, partnership and combination of individuals in any form.

745.02 PERMIT REQUIRED; POSTING; NUMBER OF SALES LIMITED.
   No person shall conduct or cause to be conducted a rummage sale in any building, room or place in the City without first making written application for a permit upon a form provided by the office of the Safety-Service Director or his or her designee therefor, paying the fee provided and obtaining a permit from the office of the Safety-Service Director or his or her designee. No permit shall be issued for a rummage sale for more than four consecutive days. No rummage sale shall begin before 8:00 a.m. or end later than 8:00 p.m., every day, including holidays. No person shall be issued more than two permits per year, and all permits shall be issued for a particular location, regardless of the person applying for the permit. The permit shall be posted in a conspicuous place upon the premises upon which the rummage sale is being conducted during the time of the rummage sale.

745.03 FEE.
   The applicant shall not be required to pay any fee when the written application for a rummage sale permit is filed with the office of the Safety-Service Director or his or her designee.
