In addition to the powers of the Utility Resolution Board granted under Chapter 939 of the Elyria Codified Ordinances, the Utility Resolution Board shall have the power to:
(a) Determine procedures and policies for the implementation and enforcement of a Backflow Prevention Program within the City;
(b) Adopt, modify, repeal and promulgate rules and regulations governing the procedures and policies of the Board with respect to hearings, filing of reports, violations, issuance of permits, fines, penalties and other matters relating to the prevention, control or abatement of backflow into public waters within the City;
(c) Set policy and hear appeals per Ohio Environmental Protection Agency and American Water Works Association Standards and the Board's rules and regulations for backflow prevention;
(d) Advise, consult and cooperate with other agencies of the state, the federal government and other state and agencies in furtherance of the purposes of backflow control and prevention;
(e) Encourage, participate in or conduct studies, investigations, research and demonstrations relating to backflow, and the causes, prevention, control and abatement thereof;
(f) Issue, modify and repeal orders preventing, abating or controlling backflow into public waters within the City;
(g) Require necessary permits, backflow control prevention devices, metering, gauging and other essentials needed in the prevention, abatement or control of backflow as required by the Board;
(h) Institute or cause to be instituted in the Court of Common Pleas having jurisdiction proceedings to compel compliance with this chapter, the rules and regulations and orders of the Board; and
(i) Exercise all incidental powers necessary to carry out the rules and regulations and policies of the Board in the prevention, abatement or control of backflow into public waters within the City.
