165.03  POSITIONS, CLASSIFICATIONS AND COMPENSATION GENERALLY.
   (a)   Except as otherwise provided by law, the positions, compensation and benefits of all employees shall be created and established from time to time as Council determines.
   (b)   There are hereby established two classifications of employees, full-time and part-time.

   (c)   Wages, plus the cost of their associated fringe benefits, of the City Engineer and the Assistant City Engineer, shall be paid one-third from the General Fund, one-third from the Water Fund, and one-third from the Wastewater Pollution Control Fund.
   Wages, plus the cost of their associated fringe benefits, of the Mayor, Director of Safety Service, any Assistant Safety Service Directors, Finance Director, and the Chief Deputy Auditor shall be paid one-fourth from the General Fund, one-fourth from the Water Fund, one-fourth from the Wastewater Pollution Control Fund, and one-fourth from the Sanitation Fund.
   Wages, plus the cost of associated fringe benefits, of other employees of the Division of Engineering, shall be as follows: three employees of the Division are to be paid from the Wastewater Pollution Control Fund; three employees of the Division are to be paid from the Water Fund; and one employee of the Division is to be paid from the Street Construction, Maintenance and Repair Fund. In the event that any employee of the Engineering Division performs work for any of the other funds of the City, the wages, plus the cost of associated fringe benefits, of such employee, may be apportioned to that fund for which such services have been performed.
   Wages, plus the cost of associated fringe benefits, of employees of the City Law Director's office, shall be as follows: three employees of such office shall be paid one-fourth from the General Fund, one-fourth from the Water Fund, one-fourth from the Wastewater Pollution Control Fund and one-fourth from the Sanitation Fund, and one employee shall be paid from the Wastewater Pollution Control Fund. In the event that any employee of such office performs work for any of the other funds of the City, the wages, plus the cost of associated fringe benefits, of such employee, may be apportioned to that fund for which such services have been performed.
   In the event that any employee of the Safety Service office performs work for any of the other funds of the City, the wages, plus the cost of associated fringe benefits, of such employee, may be apportioned to that fund for which such services have been performed.
   In the event that any employee of the Finance Director's office performs work for any of the other funds of the City, the wages, plus the cost of associated fringe benefits, of such employee, may be apportioned to that fund for which such services have been performed.

   (d)   Newly hired full-time employees shall begin their employment at the lowest step of their job classification. Thereafter, on their anniversary date, they will automatically be elevated to the next highest step until the highest step is reached. An elevation to the next highest step before the yearly anniversary date must be approved by the Personnel Placement Committee. Elected officials' appointees do not require approval from the Personnel Placement Committee prior to advancement to a higher step classification. This section shall not apply to those positions included in the 2019 Salary Study, as set forth in Section 165.33.  (Ord. 2019-28.  Passed 3-4-19.)
   (e)   When an employee is promoted to a higher classification, the City agrees to ensure an increase in such employee's rate of pay.
   (f)   A temporary promotion may be used to fill a vacancy caused by an employee being on sick leave or other approved leave of absence, or to meet an emergency. Such a temporary promotion shall not exceed ninety days.
   (g)   In the Division of Police, any Captain who is not in the Bargaining Unit shall receive the same benefit as a Captain in the Bargaining Unit.

   (h)   In the Division of Fire, any Assistant Chief who is not in the bargaining unit shall receive the same benefits as an Assistant Chief in the bargaining unit.

   (i)   In the Division of Police, any Corrections Supervisor, including the Jail Administrator, who is not in the FOP Ohio Labor Council Bargaining Unit, shall receive the same nonbase salary- related benefits as the Corrections Officers in the Bargaining Unit.

   (j)   In the Division of Police, the Chief of Police shall receive the same clothing allowance and college incentive benefits as an employee in the Fraternal Order of Police, Ohio Labor Council, Inc., Bargaining Unit.
   (k)   In the Division of Fire, the Fire Chief shall receive the same clothing allowance and college incentive benefits as an employee in the International Association of Firefighters, Local 474, Bargaining Unit.

   (l)   In the event of any reduction in the hours worked per week or per pay period of any full-time City employee as a result of lack of funds or for any other purpose as determined necessary by the Safety Service Director, the Mayor, the City Auditor or the City Law Director, then any such employee shall, during the period of any such reduction, retain all benefits which they had prior to any such reduction, with the exception of sick pay accumulation which shall be based on actual hours worked.
