§ 111.05 CONTENT OF APPLICATION.
   (A)   An applicant for an adult use original and renewal license shall furnish the following information under oath:
      (1)   The complete name, including aliases and assumed names, and residence address;
      (2)   If the applicant is a partnership, the complete name of the partnership, the names of all partners, whether the partnership is general or limited, and a copy of the partnership agreement, if any;
      (3)   If the applicant is a corporation, the complete name of the corporation, the names of each individual having a 10% or greater interest in the corporation, and a copy of the by-laws;
      (4)   If the applicant is a limited liability company, the complete name of the limited liability company, the names of all the members and managers having a 10% or greater interest in the limited liability company, and a copy of the operating agreement;
      (5)   Written proof that the individual is at least 18 years of age;
      (6)   The exact nature of the adult use to be conducted and the proposed place of business and facilities thereto, including legal description;
      (7)   Whether the applicant or any person listed in this section has been convicted of a misdemeanor or felony offense of a sexual nature, including, but not limited to, acts involving sexual crimes against children, child pornography, sexual abuse, rape or crimes connected with another adult use;
      (8)   Whether the applicant or any other person listed in this section has had a previous license under this chapter or other similar adult use ordinance from another city, village or county denied, suspended or revoked, including the name and location of an adult use for which the license was denied, suspended or revoked, as well as the date of the denial, suspension or revocation, and whether the applicant, employee or any other person listed in this section has been a partner in a partnership or an
officer, director or principal stockholder of a corporation that is permitted under this chapter whose permit has previously been denied, suspended or revoked, including the name and location of the adult use for which the license was denied, suspended or revoked as well as the date of denial, suspension or revocation;
      (9)   Whether the applicant or any one listed in this section holds any other license or permit under this chapter or other similar adult use business ordinance from another city, village, or county and, if so, the names and locations of other permitted businesses;
      (10)   The location of the proposed adult use, including a legal description of the property, street address and telephone numbers, if any;
      (11)   A recent photograph of the applicant(s);
      (12)   The applicant’s driver’s license number, Social Security number and/or his or her state- or federally-issued tax identification number;
      (13)   A sketch or diagram showing the configuration of the premises, including a statement of total floor space occupied by the adult use. The sketch or diagram need not be professionally prepared, but it must be drawn to a designated scale or drawn with marked dimensions of the interior of the premises to an accuracy of plus or minus six inches;
      (14)   A current certificate and straight-line drawing prepared within 30 days prior to the application by an Illinois registered land surveyor depicting the property lines and the structures containing any established existing uses regulated by this article within 1,000 feet of the property to be certified; the property lines of any established religious institution/synagogue, school or public park or recreation area within 1,000 feet of the property to be certified; and the property lines of any residentially zoned area or residential property within 1,000 feet of the property to be certified. For purposes of this section, a use shall be considered existing if it is in existence at the time an application is submitted;
      (15)   If a person who wishes to operate an adult use is an individual, he or she must sign the application for a license as applicant. If a person who wishes to operate an adult use is other than an individual, each individual who has a ten percent or greater interest in the business must sign the application for a permit as an applicant. If a corporation or limited liability company is listed as owner of an adult use or as the entity which wishes to operate such a business, each individual having a ten percent or greater interest in the corporation or limited liability company must sign the application for a license as applicant; and
      (16)   The applicant shall be required to provide the village with the names of any and all employees who are required to be licensed pursuant to § 111.25 below. This shall be a continuing requirement even after a license is granted or renewed.
   (B)   Applicants for a license under this section shall have a continuing duty to supplement the application information required by this section in the event that the information changes in any way from what is stated on the application. The failure to comply with the duty to supplement within 30 days from the date of the change, shall be grounds for suspension of a license.
   (C)   The applicant must be qualified according to the provisions of this chapter and the premises must be inspected and found to be in compliance with health, fire and building codes and laws.
   (D)   Prior to obtaining any license to operate an adult use defined in this chapter, the applicant shall obtain from the village or its designee a certification that the proposed location of the adult use complies with the location requirements in § 111.33 below.
   (E)   By applying for a permit under this chapter, the applicant shall be deemed to have consented to the provisions of this chapter and to the exercise by the Village Clerk or his or her designee, the Village Police Department and all other village agencies charged with enforcing the laws, ordinances and codes applicable in the village.
