§ 95.99  PENALTY.
   (A)   Any person who undertakes excavation on village streets or the public right-of-way without having first obtained a permit shall be guilty of unpermitted excavation of public streets, a misdemeanor of the fourth degree.
   (B)   Any person who undertakes excavation on village streets pursuant to a permit obtained under the provisions of §§ 95.02 through 95.06 and 95.10, who knowingly or voluntarily breaches a condition of the permit as defined herein, shall be guilty of violation of an excavation permit, a minor misdemeanor.
   (C)   In cases of violation hereunder, each day that a condition or prohibited conduct continues shall be a separate offense, and shall be separately charged.  (Ord. 24-90, passed 11-29-1990)
   (D)   Any person violating any provision of this chapter for which no penalty is otherwise provided shall be fined as set forth in § 10.99.
