No person or agency shall undertake or commence any excavation or removal of the surface of village streets and roads, or in the public right-of-way, whether for purposes of repairing underground utilities or otherwise, without having first obtained a written permit from the village. For purposes of this subchapter, the term
EXCAVATION shall be construed to include jacking or tunneling under the roadway. In cases of emergency, work may be commenced prior to obtaining a permit, provided that the required permit shall be obtained without fail on the next working day without exception.
