The BOCA National Plumbing Code, as adopted in Section 1440.01, is hereby amended as follows:
Whenever the words “name of jurisdiction” appear in brackets in the Code, the words “Borough of Ellwood City” shall be inserted in place of those bracketed words. Likewise, the words “Borough of Ellwood City” shall be substituted for the word “jurisdiction” where it appears singly in the Code without being followed by the words “under the.”
The term “chief appointing authority of the jurisdiction” and the term “chief authority of the jurisdiction,” as used in the Code, shall mean the Borough Council.
The term “code official,” as used in the Code, shall mean and refer to the Plumbing Inspector.
The word “department” and the term “department of plumbing inspection,” as used in the Code, shall mean and refer to the office of the Building Inspector.
The term “legal officer of the jurisdiction,” as used in the Code, shall mean the Borough Solicitor.
P-100.1 Title: (Amended) These regulations shall be known as the Plumbing Code of the Borough of Ellwood City, Pennsylvania, hereinafter referred to as “the code” or “this code.”
P-104.1 Continuation: (Amended) The legal use and occupancy of any structure existing before the effective date of the ordinance adopting this code, or which had been approved before that effective date, may be continued without change except as may be specifically covered in this code or deemed necessary by the Plumbing Inspector for the general safety and welfare of the occupants and the public.

P-110.1 General: (Amended) The Building Inspector shall serve as the Plumbing Inspector and shall administer and enforce all provisions of this code. He or she shall act on any question relative to the mode or manner of construction and the materials to be used in the installation of plumbing work, except as may otherwise be specifically provided by other requirements of this code.

P-111.1 Permit required: (Amended) Plumbing work shall not be commenced until a permit for the work has been issued by the Plumbing Inspector. A permit is not required for repairs which involve only the working parts of a faucet or valve, clearance of stoppages, or repairing or replacement of defective faucets or valves, provided alterations are not made in the existing piping or fixtures. A plumbing permit shall be issued as part of a building permit when and as determined by the Building Inspector.

P-115.3 Right of entry: (Amended) In the discharge of his or her duties, the Building Inspector or an authorized representative shall, upon showing proper identification, have the authority to enter at any reasonable hour any building, structure or premises in the Borough to enforce the provisions of this code.
P-117.2 Notice: (Amended) The Building Inspector shall serve a notice of violation or order on the person responsible for the installation of plumbing work in violation of any provision of this code, or in violation of a detailed statement or a plan approved under this code, or in violation of a permit or certificate issued under the provisions of this code. The notice of violation or order shall direct the discontinuance of the illegal action or condition and the abatement of the violation, and shall allow a reasonable time for the initiation and correction of such violation or the remedial actions required to correct such violation, except where emergency conditions exist which require immediate corrective action. When not otherwise specified, every seven days that the prohibited conditions are maintained after the date of the notice shall constitute a separate offense.
P-117.4 Penalties: (Amended) Any person who violates any provision of this code or who fails to comply with any of the requirements of this code, or who installs plumbing work in violation of an approved plan or directive of the Building Inspector, or of a permit or certificate issued under the provisions of this code, shall be guilty of a summary offense punishable as provided in Section 202.99(a) of the Administration Code of the Codified Ordinances of Ellwood City.
Provided: The imposition of one penalty for any such violation shall not excuse the violation or permit it to continue, and all such persons shall be required to correct or remedy such violations or defects within a reasonable time. When not otherwise specified, every seven days that prohibited conditions are maintained shall constitute a separate offense.
P-118.2 Unlawful continuance: (Amended) Any person who shall continue any plumbing work in or about the structure after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe conditions, shall be subject to the penalty provided in Section 202.99(a) of the Administration Code of the Codified Ordinances of the Borough of Ellwood City.

P-303.2 Public systems available: (Amended) A public water main or public sewer system shall be considered available wherever there is a public water main or a public sewer, as the case may be, in the street or alley abutting the property in question.
P-308.3 Freezing: (Amended) Water service piping and sewers shall be installed below recorded frost penetration, but not less than 3 feet below grade for water piping, and 2 feet 6 inches below grade for sewers. Plumbing piping in exterior building walls shall be adequately protected against freezing by insulation or heat or both.
P-308.4 Building sewers: (Amended) Building sewers that connect to private sewage disposal systems must be at least 3 inches in diameter and constructed of a material established by this code. Building sewers that connect to private sewage disposal systems shall be a minimum grade of 1/8 inch per foot and a maximum grade of 1/4 inch per foot for the 10 feet of building sewer immediately preceding the treatment tank. Whenever building sewers are extended a considerable distance to reach the treatment tank, the trench the sewer is laid in must be stable in order to prevent settling. Cleanouts shall be provided at intervals of not more than 50 feet on lines of 4 inches or less, and of not more than 100 feet for larger pipes.
