(a) Waiver of Requirements. The Borough may waive the requirements of Sections 1244.03 and 1244.04 for minor subdivisions requiring no additional streets or street openings, upon the request, in writing, of the developer, with review by the Borough Planning Commission, for the waiver of the applicable requirements. In the case where a waiver is granted, the application for final plan approval shall be filed along with the plans and data required in subsection (b) hereof and shall be processed according to Section 1244.04 and this section.
(b) Plans and Data. Developers granted a waiver under subsection (a) hereof shall submit an application which shall include, but not be limited to, the following:
(1) A plan at a scale of no less than one inch equals 100 feet, drawn on mylar or similar material not to exceed twenty-four by thirty-six inches;
(2) A location map;
(3) The following information:
A. A description of covenants;
B. A title box, to include the name and address of the owner(s), the name and seal of the registered engineer or land surveyor, a north point, a graphic scale and the date;
C. The proposed use of the land;
D. Lot lines, dimensions and the land area of the proposed lot;
E. Existing streets, alleys and easements on the tract and adjacent tracts;
F. Available utilities;
G. Planning modules specified by the Department of Environmental Resources;
H. The names of abutting property owners;
I. A sketch plan showing the entire parcel and its relationship to any significant development, highways and/or environmental conditions;
J. Any other certificates, permits or dedications which may be required in the enforcement of these Subdivision and Land Development Regulations.
(c) Resubdivision or Replatting. In the combination or recombination of lots or portions of previously recorded lots, when the resultant lots are increased in street frontage and total area so that they meet or exceed the standards of these Regulations, the procedures and requirements shall be met except as may be further modified by Council.
