1046.38   DISCONNECTION BY BOROUGH FOR REASONS OTHER THAN DELINQUENCY.
   (a)   Violation of Chapter. The Borough may disconnect service to any customer because of a violation of this chapter or any of the Borough's applicable rules and regulations.
   (b)   Safety Shut-Off. The Borough may disconnect its service to any customer, without notice, if the customer's installation has become dangerous or defective or if, upon examination of the customer's installation by an inspection agency approved by the Borough, a certificate of approval is refused.
   (c)   Shut-Off for Fraud. The Borough may disconnect its service to any customer, without notice, for abuse, fraud or tampering with the meters, connections or other equipment of the Borough.
   (d)   Reconnection Charge. Service disconnected by the Borough under the provisions of subsection (a), (b) or (c) hereof will be restored only on payment in advance of a fee, which shall be determined from time to time by resolution of Council, in addition to all arrearages due from the customer, except when it is necessary to remove service wires to effect discontinuance of service. In the latter case, service will be restored only upon payment to the Borough of all costs of discontinuance and restoration in addition to all such arrearages.
   (e)   New Deposit; Reconnection Fee. The Borough shall require a new deposit plus a reconnection fee following any termination other than for delinquency. The reconnection fee shall be established from time to time by resolution of Council.
   (f)   Medical Emergency Procedures. If, prior to the termination of service, an employee of the Electric Department is informed that an occupant is seriously ill or is afflicted with a medical condition which will be aggravated by the termination of service and that a medical certification will e procured, termination shall not occur for at least three days. Service may be terminated if no certification is produced within that three-day period. Such certification shall be made by a qualified physician and shall include the following:
      (1)   The name and address of the customer in whose name the account is registered;
      (2)   The name and address of the afflicted person and his or her relationship to the customer;
      (3)   The nature and anticipated length of the affliction;
      (4)   The specific reason for which the service is required;
      (5)   The name, office address and telephone number of the certifying physician.
