§ 112.99 PENALTY.

   (A)   Operating as secondhand dealer without a license.

      (1)   First offense, $100, Class D ordinance violation.

      (2)   Second offense, $500, Class C ordinance violation.

      (3)   Third and subsequent offenses, $2,500, Class A ordinance violation.

   (B)   Failure to hold purchases for sale as required by § 112.04.

      (1)   First offense, $500, Class C ordinance violation.

      (2)   Second offense, $2,500, Class A ordinance violation.

      (3)   Third offense, $2,500, Class A ordinance violation and license revocation.

   (C)   Failure to keep records as required by § 112.05(A) for each article sold or received.

      (1)   First offense, $500, Class C ordinance violation.

      (2)   Second offense, $2,500, Class A ordinance violation.

      (3)   Third offense, $2,500, Class A ordinance violation and license revocation.

   (D)   Failure to timely complete and submit a list each week to the Police Department of all information submitted to the law enforcement website, as required by § 112.05(B), for each article sold or received.

      (1)   First offense, $500, Class C ordinance violation.

      (2)   Second offense, $2,500, Class A ordinance violation.

      (3)   Third offense, $2,500, Class A ordinance violation and license revocation.

   (E)   The Police Department shall write the notices of violation.
