(A) Each Town Water Company customer shall be responsible for compliance of § 51.51 of this subchapter with respect to the premises where the customer receives water service. If the identity of the water user cannot be ascertained, the customer shall be prima facie liable for violations that occur on said premises.
(B) A person shall receive a written warning for the first violation. The person's second violation of § 51.51 shall be subject to an admission of violation and payment of designated civil penalty through the Ordinance Violations Bureau in connection with § 10.17 of the Town Code. A person's second violations of § 51.51 shall be a Class D ordinance violation, and the penalty shall be $100 for the violation.
(C) Each subsequent violation of § 51.51 shall be Class C ordinance violation, and the penalty shall be $500 for each violation. The Class C ordinance violations shall be referred to the Town Attorney for further proceedings.
(D) All monies collected from the violations of this chapter shall be deposited in the Utility General Fund.
