(A) Appointment. The Clerk/Treasurer is appointed and shall serve as the violations clerk for purposes of this section.
(B) Duties. As violations clerk, the Clerk/Treasurer may accept (1) written appearances, (2) waivers of trial, (3) admissions of violations and (4) payment of civil penalties of not more than $100 in ordinance violation cases, subject to the schedule prescribed by the town code.
(C) Accounting. The amounts received by the Clerk/Treasurer shall be receipted by and accounted for by the Clerk/Treasurer under the procedures provided for by the state board of accounts. Payments of civil penalties to the Clerk/Treasurer may be made in person or by mail.
(D) Procedure. A person charged with an ordinance violation or a code violation is entitled to a trial before a court as provided by law, unless the person waives the right to trial and enters an admission.
(1) A person against whom a complaint of an ordinance violation is issued shall within ten days of the date of issuance of the complaint appear at the Clerk/Treasurer's office to admit or deny the violation or shall have delivered to the Clerk/Treasurer's office either the person's written waiver of trial and admission along with the entire penalty payment or the person's written denial of the complaint.
(2) If a person (a) denies an ordinance or code violation, (b) fails to satisfy a civil penalty assess by the Clerk/Treasurer after having entered an admission of violation, or (c) fails to deny or admit the violation the Clerk/Treasurer shall report this fact to the Town Council and the Town Council shall determine whether to refer such cases to the Town Attorney for further proceedings.
