§ 98.10 URBAN WOOD UTILIZATION, EDUCATION AND TREE PLANTING PROGRAM - ELKHARTWOOD.
   (A)   The urban wood utilization, education and tree planting program to be called "Elkhartwood" is hereby established by this section. The purpose of the program is to promote the public health, welfare and safety of our citizens by ensuring a healthy tree canopy throughout the city and the area immediately surrounding the city.
   (B)   (1)   The Board of Public Works may sell any logs removed from public places in the city. The proceeds of such sales shall be deposited in a special non-reverting fund designated as the Urban Wood Fund. All monies in the Urban Wood Fund shall be used:
         (a)   For the purchase of trees to be planted on public lands by city employees and interested community groups; and
         (b)   To purchase any other items necessary to fulfill the purposes of this section.
      (2)   Any trees purchased and planted as part of this program shall become the property of the landowner.
   (C)   The Board of Public Works is authorized to adopt any program guidelines and to enter into any agreements necessary to fulfill the purposes of this section.
