§ 98.08 NOTICES AND APPEALS.
   (A)   All notices required to be given in this chapter shall be in writing and shall be mailed by United States certified mail, return receipt requested, to the owner of the real property involved, at his last known address as the address appears on the roll, and notice shall also be posted in a conspicuous place on the real property.
   (B)   Any person affected by a decision of the Board or the Superintendent may appeal the decision within 10 days of the receipt of notice. All appeals, whether from decisions of the Superintendent or decisions of the Board, shall be heard by the Board. An appeal from the decision of the Board shall be considered an appeal for the Board to reconsider its decision. Decisions of the Board, pursuant to an appeal, shall be final.

§ 98.09 LIABILITY.
   Nothing in this chapter shall be deemed to impose any liability upon any member of the Council, the city or any of its officers or employees, nor to relieve the owner and occupant of any private property from the duty to keep his or her private property, sidewalks and parkway in front of the property in a safe condition, and so as not to be hazardous to public travel.

§ 98.10 URBAN WOOD UTILIZATION, EDUCATION AND TREE PLANTING PROGRAM - ELKHARTWOOD.
   (A)   The urban wood utilization, education and tree planting program to be called "Elkhartwood" is hereby established by this section. The purpose of the program is to promote the public health, welfare and safety of our citizens by ensuring a healthy tree canopy throughout the city and the area immediately surrounding the city.
   (B)   (1)   The Board of Public Works may sell any logs removed from public places in the city. The proceeds of such sales shall be deposited in a special non-reverting fund designated as the Urban Wood Fund. All monies in the Urban Wood Fund shall be used:
         (a)   For the purchase of trees to be planted on public lands by city employees and interested community groups; and
         (b)   To purchase any other items necessary to fulfill the purposes of this section.
      (2)   Any trees purchased and planted as part of this program shall become the property of the landowner.
   (C)   The Board of Public Works is authorized to adopt any program guidelines and to enter into any agreements necessary to fulfill the purposes of this section.

§ 98.99 PENALTY.
   Violation of this chapter shall be a misdemeanor punishable by fine of not more than $500. Each day of violation shall constitute a separate offense.
