§ 52.02  RATES AND CHARGES.
   The following is a schedule of electric rates and charges.
   (A)   Tariff E11: All electric residential and farm service (frozen).
      (1)   Availability.  Available for existing customers only. No new accounts will be added.
      (2)   Rate.
         Consumer charge:          $11.00 per month
         Energy charge
         1 to 1,000 kWH         $ 0.0914
         Over 1,000 kWH         $ 0.0865
      (3)   Minimum charge. The minimum charge per meter shall be $15.61.
      (4)   Penalty charge.   
         On the first $3 or less of net billing:   10%
         On all excess of $3 of net billing:      3%
      (5)   Application of collection charge on delinquent bills. (Refer to Appendix B)
      (6)   Rate adjustment. The above rates are subject to a Purchased Power Cost Adjustment Tracking Factor in accordance with the Order of the Indiana Utility Regulatory Commission approved May 2, 1994 in Cause No. 36835-S2. The Purchased Power Cost Adjustment Tracking Factor stated in Appendix A is applicable hereto and is issued and effective at the dates shown on Appendix A.
      (7)   Non-recurring charges. (Refer to Appendix B)
   (B)   Tariff E12: Electric commercial service
      (1)   Availability. Available for commercial  service including  commercial  lighting, miscellaneous small appliances, refrigeration, cooking, water heating, and incidental small motors not exceeding three (3) horsepower individual capacity. Single phase less than  transformer  capacity of 100 KVA. Applicant  must  be located on the utility's  distribution lines suitable for supplying the service.
      (2)   Character of service. Alternating  current, 60 hertz, single phase, at a voltage of approximately 120-240 volts three-wire.
      (3)   Rate.

      (4)   Minimum charge. The minimum charge shall be the consumer charge.

      (9)   Rate adjustment. The above rates are subject to a Purchased Power Cost Adjustment Tracking Factor in accordance with the Order of the Indiana Utility Regulatory Commission approved May 2, 1994 in Cause No. 36835-S2. The Purchased Power Cost Adjustment Tracking Factor stated in Appendix A is applicable hereto and is issued and effective at the dates shown on Appendix A.
      (10)   Non-recurring charges. (Refer to Appendix B)
   (C)   Tariff E13: Electric residential service.
      (1)   Availability. Available for residential service,  including residential lighting, household appliances, refrigeration, cooking appliances, water heating and small motors not exceeding  three  horsepower individual capacity. Applicant must be located on the utility distribution lines suitable for supplying the service requested in the town.
      (2)   Character of service. Alternating current, 60 hertz, single phase, at a voltage of approximately 120-240 volts three-wire.
      (3)   Rate.

      (4)   Minimum charge. The minimum charge shall be the consumer charge.

      (9)   Rate adjustment. The above rates are subject to a Purchased Power Cost Adjustment Tracking Factor in accordance with the Order of the Indiana Utility Regulatory  Commission approved May 2, 1994 in Cause No. 36835-S2. The Purchased Power Cost Adjustment  Tracking Factor stated in Appendix A is applicable hereto and is issued and effective at the dates shown on Appendix A.
      (10)   Non-recurring charges. (Refer to Appendix B)
   (D)   Tariff E14: General power service.
      (1)   Availability. Available for any power purpose with transformer capacity less than 300 KVA. Applicant must be located on the utility's distribution lines adequate and suitable for supplying the service requested in the town, and adjacent territory.
      (2)   Character of service. Alternating current 60 hertz, three phase at a voltage approximately 120/208 volt four wire, 277/480 volt four wire, 480 volt three wire or 240 volt three wire.
      (3)   Rate.
         Consumer Charge            $30.00 per month
         Energy Charge
            All KWH             $0.0950 per KWH
          Demand Charge (where applicable)    $5.00 per KW
Applies to year-round service with seasonal or loads with peak month greater than two time the annual average.
      (4)   Minimum charge. The minimum charge shall be the consumer charge.
      (5)   Terms and conditions. Service shall be provided based upon the Electric Rules and Regulations.
      (6)   Penalty charge. (Refer to Appendix B)
      (7)   Application of collection charge on delinquent bills. (Refer to Appendix B)
      (8)   Rate adjustment. The above rates are subject to a Purchased Power Cost Adjustment Tracking Factor in accordance with the Order of the Indiana Utility Regulatory Commission approved May 2, 1994 in Cause No. 36835-S2. The Purchased Power Cost Adjustment Tracking Factor stated in Appendix A is applicable hereto and is issued and effective at the dates shown on Appendix A.
      (9)   Non-recurring charges. (Refer to Appendix B)
   (E)   Tariff Code 5: Large power.
      (1)   Availability. Available to any power consumer for  year- round service with installed capacity of 300 KVA and greater who is located on the company's distribution lines suitable and adequate for supplying service requested. Not available as standby power.
      (2)   Character of service. Alternating current 60 hertz, three-phase service at a voltage of  approximately 480 volts three-wire, 120/208 volts four wire, 277/480-volt four wire or other voltage approved by the utility.
      (3)   Rates.
         Consumer Charge         $60.00 per month
         Demand Charge         $ 8.50 per KVA
         Energy Charge
            All KWH         $0.06080 per KWH
      (4)   Monthly minimum charge. Shall be the consumer charge and load charges or contract whichever is greater.
      (5)   Determination of billing demand.
         (a)   The billing demand  for any such month shall be the maximum kilowatt demand established by the consumer for any 30-minute period for month's billing period. The load shall be as indicated or recorded by suitable recording instruments provided  by the electric utility and adjusted for power factor as provided within this schedule.
         (b)   When highly fluctuating or intermittent loads (such as welding machines, electric furnaces, x-rays and the like) are in operation by the consumer, the utility reserves the right to set the minimum billing demand at the nameplate or volt-ampere rating of the equipment.
      (6)   Power factor. The consumer agrees to maintain unity power factor as nearly as practical. The electric utility will measure the power factor. Should such measurement indicate that the power factor is less than unity (lagging) at time of non-coincident peak, then the demand for billing purpose will be adjusted for the monthly non-coincident peak demand period by dividing the demand by the percent factor.
      (7)   Terms and conditions.
         (a)   Service shall be provided based upon the Electric Utility's Rules and Regulations.
         (b)   Service under this schedule shall be furnished at one location through one meter or metering installation installed and maintained by company.
         (c)   The term "month" as used herein shall mean the period between any two consecutive regular readings by company of the meter or meters used in determining the kilovolt-amperes of maximum load and the amount of electric energy supplied customer by company hereunder. Such regular readings shall be taken by company as nearly as practicable every 30 days.
         (d)   Metering and voltage shall be in accordance with:
            1.   The Indiana Regulatory Commission of Indiana "Rules and Standards of Service for the Electrical Public Utilities of Indiana" as from time to time promulgated by said Commission; and
            2.   The American Standards Association publication "ASA CSr.1-1954" dated May, 1949 to the extent that the same is not in conflict with division (7)(d)1. above.
         (e)   In case a fire or other casualty shall render the plant or premises of customer wholly unflt for the purposes of customer's business, the minimum charge specified shall, commencing with the first full billing month thereafter, be suspended until the beginning of the billing month in which the premises shall have been reconstructed and reoccupied by customer. In case a strike or lockout causes the temporary suspension of the operation or business of customer, the minimum charge specified will be waived for each full billing month during the continuance of said strike or lockout, but customer shall, for each such month, be billed and be liable for the payment, at the rates herein set out for a primary charge based upon the maximum load actually used for such month, and secondary charge determined on the basis of such actual maximum load.
         (f)   The town may require corrective measures or devices for any motor or apparatus which, in the opinion of the town, may cause voltage fluctuations to other members. Unless otherwise permitted, the maximum primary voltage fluctuation will be 3%.
         (g)   The consumer shall be responsible to maintain voltage and current limits as defined within IEEE Standard 519 at point of common coupling.
         (h)   The consumer shall be responsible for properly installing equipment for overcurrent protection and under voltage, overvoltage, phase reversal and/or loss of phase relays for the protection of member's own equipment.
      (8)   Penalty charge. (Refer to Appendix B)
      (9)   Application of collection charge on delinquent bills. (Refer to Appendix B)
      (10)   Reconnection charge. (Refer to Appendix B)
      (11)   Rate adjustment. The above rates are subject to a Purchased Power Cost Adjustment Tracking Factor in accordance with the Order of the Indiana Utility Regulatory Commission approved May 2, 1994 in Cause No. 36835-S2. The Purchased Power Cost Adjustment  Tracking Factor stated in Appendix A is applicable hereto and is issued and effective at the dates shown on Appendix A.
      (12)   Non-recurring charges. (Refer to Appendix B)
   (F)   Tariff Code 6: Industrial power service.
      (1)   Availability. Available to industrial customers for electric power service at a standard primary or transmission line voltages. Customer shall contract for a specified capacity of not less than 1,000 KVA and must be located adjacent to an electrical primary distribution line or transmission line of company that is adequate and suitable for supplying the service requested. All equipment beyond the metering point will be owned by the customer. This schedule is not applicable to resale or standby service.
      (2)   Character of service. Alternating current 60 hertz, three phase four wires at a voltage approximately 7,200/12,470 volts.
      (3)   Rate.
         Consumer Charge            $120.00 per month
         Demand Charge            $12.25 per KVA
         Energy Charge            $0.0500 per KWH
      (4)   Monthly minimum charge. The monthly minimum charge shall be the consumer charge and load charges or contract whichever is greater.
      (5)   Measurements of maximum load and energy. Maximum load shall be measured by suitable indicating or recording instruments, and, in any month the maximum load shall be the average number of kilovolt-amperes during the 30-minute interval during which the kilovolt-ampere load is greater than in any other 30-minute interval in such month. Energy shall be measured by suitable integrating instruments. Company shall meter at primary voltage on the source side of the consumers owned protective device or transformation.
      (6)   Power factor. The consumer agrees to maintain unity power factor as nearly as practical. The electric utility will measure the power factor. Should such measurement indicate that the power factor is less than unity (lagging) at time of non-coincident peak, and then the demand for billing purpose will be adjusted for the monthly non-coincident peak demand period by dividing the demand by the percent factor.
      (7)   Terms and conditions.
         (a)   Service shall be provided based upon the Electric Utility's Rules and Regulations.
         (b)   Service under this schedule shall be furnished at one location through one meter or metering installation installed and maintained by utility.
         (c)   Customer shall furnish, own and maintain, at his own expense, the complete substation structure and equipment, including switches and protective equipment, transformers and other apparatus, any or all of which is necessary for customer to take service at the standard primary or transmission line voltage selected by company. Company will, however, furnish, own, and operate and maintain all necessary metering equipment.
         (d)   All wiring, pole lines, wires, and other electrical equipment and apparatus located beyond point of connection of customer's service lines with the lines of company are considered the distribution system of Customer and shall be furnished, owned, and maintained by customer, except in the case of metering equipment and other equipment incidental to the rendering of service, if any, that is furnished, owned and maintained by company, and installed beyond point of connection.
         (e)   The term "month" as used herein shall mean the period between any two consecutive regular readings by company of the meter or meters used in determining the kilovolt-amperes of maximum load and the amount of electric energy supplied customer by company hereunder. Such regular readings shall be taken by company as nearly as practicable every 30 days.

   (G)   Tariff Code 7: Industrial power secondary metering.
      (1)   Availability. Available to any power consumer for  year- round service with installed capacity of 1,000 KVA and greater who is located on the company's  distribution  lines suitable and adequate for supplying service requested. Not available as standby power.
      (2)   Character of service. Alternating current 60 hertz, three-phase service at a voltage of approximately 480 volts three-wire, 277/480-volt four wire or other voltage approved by the utility.
      (3)   Rates.

         Demand Charge            $ 12.25 per KVA
         Energy Charge
            All kWH            $0.050700 per KWH
      (4)   Monthly minimum charge. Shall be the consumer charge and load charges or contract whichever is greater.
      (5)   Determination of billing demand.
         (a)   The billing demand for any such month shall be the maximum kilowatt demand established by the consumer for any 30-minute period for month's billing period. The load shall be as indicated or recorded by suitable recording instruments provided by the electric utility and adjusted for power factor as provided within this schedule.

The Purchased Power Cost Adjustment Tracking Factor stated in Appendix A is applicable hereto and is issued and effective at the dates shown on Appendix A.
      (12)   Non-recurring charges. (Refer to Appendix B)
   (H)   Rider Schedule DG: Distributed generation electric service rate schedule less than or equal to 10 KW.  Edinburgh Power and Light Utility  hereafter  called the("utility") shall charge and collect for distributed generation electric service on the following bases of availability, application, character of service, monthly rate, minimum  charge, purchased power cost adjustment clause, and tax adjustment.
      (1)   Availability. This rate is available  to any member  of the utility that currently meets the conditions of service and any member of the Utility located within the territory served by the  utility. It will be available to consumers who have qualified  distributed generation facilities of not more than a nameplate rating of 10 KW and that may interconnected with utility's distribution  system.
      (2)   Application. This schedule is applicable to all electric service used exclusively for domestic purposes to individually metered  single-family dwelling units; to individually  metered  dwelling  units in duplexes, apartments, and condominiums; and to individually  metered  farm buildings located on privately owned farm operations.
      (3)   Character of service. Service under this schedule shall be single phase, 60 Hertz, alternating current at the utility's  available standard voltages.  Some motor restrictions  will apply. All residential service required on the premises by the customer will be  supplied through one meter. New or different metering cost will be by customer.
      (4)   Rates.
         Consumer Charge         $27.00 per month

Billing Note: If the customer owing or leasing a renewable generation facility produces more energy from such facility than the customer's electric load at that meter, then the excess energy shall be purchased  from the customer by IMPA pursuant to the terms of a separate power purchase agreement between the customer and IMPA.
      (5)   Minimum charge. The minimum charge shall be the consumer charge.
      (6)   Penalty charge. (Refer to Appendix B)
      (7)   Application of collection charge on delinquent bills. (Refer to Appendix B)
      (8)   Reconnection charge. (Refer to Appendix B)
      (9)   Rate adjustment. The above rates are subject to a Purchased Power Cost Adjustment Tracking Factor in accordance with the Order of the Indiana Utility Regulatory Commission approved May 2, 1994 in Cause No. 36835-S2. The Purchased Power Cost Adjustment Tracking Factor stated in Appendix A is applicable hereto and is issued and effective at the dates shown on Appendix A.
      (10)   Rate - cost adjustment. The amount computed at the above  monthly rate shall be adjusted plus or minus by an amount calculated  in accordance with the tracker specified by IMPA the utility's  wholesale supplier (Appendix A) which is a part of the "Monthly  Rate" of this rate schedule.
      (11)   Distributed - generation credit adjustment. The amount  computed at the above monthly rate shall  be adjusted plus or minus by  an amount calculated in accordance with the tracker specified by IMPA  the utility's wholesale supplier (Appendix A) which is a part of the "Monthly Rate" of this rate schedule.
      (12)   Terms and conditions of service.
         (a)   An Interconnection Application and a Distribution  Generation Agreement shall be required between the consumer and the utility.
         (b)   This service shall be provided based upon the Electric Utility Rules and Regulations.
Consumers  requesting  service  under  this  optional  rider  must  remain on the rider for a minimum  of 12  months. The utility  reserves  the right to discontinue the use of this optional rider if a consumer's qualified distributed generation facility is permanently removed from service.
      (13)   Definitions. As used in this rate, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
         "CONSUMER." An electric member of the utility.
         "CREDIT GIVEN TO CONSUMER." The purchase of electric energy from a qualifying distributed generation facility by the utility.
         "ENERGY  CHARGE." The charge for electric energy or capacity supplied by the Utility, regularly used by a qualifying  distributed generation facility in addition to that which the facility generates itself.
         "INTERCONNECTION." The physical, parallel connection  of a qualifying facility with a distribution facility of the utility for the purchase or sale, or both, of electricity.
         "PARALLEL." The  designed  operation  of  the  qualifying  distributed generation facility, interconnection equipment, and the Utility's system where the instantaneous flow of electrical energy may automatically occur in either direction across the interconnection point between the qualifying facility and the utility's distribution system.
         "QUALIFIED  DISTRIBUTED  GENERATION  FACILITY." A generating plant or facility:
            1.   Constructed,  maintained,  operated, or owned  by a consumer and which is operated on the consumer's side of the retail meter and such project or facility has a generating capacity of not more than a nameplate rating of 10 kilowatts; or
            2.   Constructed, maintained, operated, owned by a consumer and connected directly to the utility's distribution system  including, without limitation, photovoltaic, fuel cell,  micro-turbine,  biomass, hydro and internal combustion generators.
      (14)   Customer safety related requirements.
         (a)   Any qualified distributed generation facility used by a consumer pursuant to the rate shall meet all applicable safety and performance standards established by the National Electric Code, the Institute of Electrical and Electronics Engineers including standard IEEE 1547 and the Underwriters Laboratories.
         (b)   The consumer must obtain at his or her expense, all necessary inspections and approvals required by codes prior to connecting the facility to the cooperative's system. The consumer will supply the utility with certification that the facility has received all necessary code approvals and that it meets, or exceeds, all applicable safety and performance standards.
         (c)   Parallel operation with the utility's system must cease immediately and automatically during system outages and other emergency or abnormal conditions as specified by applicable codes and standards.  Outages include, but are not limited to, momentary outages due to system reclosing and protective devices operating on the utility system.  The consumer's  generator must cease parallel operation upon notification by the utility if such operation is deemed unsafe or interferes with the supply of service to others, or interferes with system operation or maintenance. The utility accepts no responsibility for damage or injury to any person or property caused by the failure of the consumer to operate in compliance with the utility's or any other requirements.
         (d)   Failure of the consumer to comply with any of these requirements shall result in disconnection from the utility's system.  The utility will be under no obligation to reconnect the consumer until the consumer's generation facility either complies with the requirements or is permanently disconnected from any parallel operation with the utility' s system.
      (15)   System modifications. If it is necessary for the utility to modify portions of its existing system to provide larger capacity facilities or metering to accommodate the purchase of electricity from the consumer, the consumer will be responsible for the costs of said upgrades. Should system modification be necessary, the utility, at the consumer's expense, shall perform all work on the utility's side of the meter.
   (I)   Tariff SL: Street lighting.
      (1)   Availability. Available to the town for public street and highway lighting.
      (2)   Rate. For standard overhead public street lighting service.

   (J)   Tariff DD: Dusk to dawn lighting service.
      (1)   Availability. Available only  for continuous year-round  service for outdoor lighting to any residential, farm, commercial, or industrial customer located adjacent to an electric  distribution  line of utility that is adequate and suitable for supplying the service  requested.  Consumer must have a standard metered service and pay the residential consumer charge.
      (2)   Character of service. Dust-to-dawn outdoor lighting service using lamps available under this schedule.
      (3)   Rate.

      (4)   Hours of lighting. All lamps shall burn approximately one-half hour after sunset until approximately one-half hour before sunrise each day in the year, approximately 4,000 hours per annum.
      (5)   Ownership of system.
         (a)   All facilities installed by the utility for service hereunder including fixture, controls, poles, transformers, secondary lines, lamps  and other appurtenances shall be owned and maintained by the utility. All service and necessary  maintenance will be performed only during regularly scheduled working hours of the utility. Non-operative lamps will normally be restored to service within 48 hours after notification by the customer.
         (b)   When the customer requests that a lamp be mounted on the customer's pole or building, the customer waives any claim for  damages caused by the installation and or removal of secondary and  lamp support.
