(A) No person shall have, hold, sponsor, or cause to be had, held, or sponsored, or allow to be had, held or sponsored, any special event without having first applied for and received a permit from the town, except as provided in § 130.63.
(B) All applications for special event permits must be made through Town Manager’s office. A completed application must be submitted for each event proposed. No application shall be considered submitted until all information required on the application form has been provided.
(C) Applications for special event permits shall be submitted no less than 30 business days prior to the date of the special event. The Town Manager or his/her designee shall have the authority to reduce this time period for good cause shown. The appropriate fee in certified funds must accompany the application for it to be considered submitted.
(D) The Town Manager’s office will forward special event applications for review by the Police Department, Fire Department, County Emergency Medical Services and/or other departments and agencies as needed based on the event parameters.
(E) Review comments on the application are due within seven days. If no comments are received within seven days, the application may be approved and the permit may be issued.
(F) For informational purposes, the following organizations may also be notified and/or require their own permits:
(1) North Carolina Department of Transportation (NCDOT);
(2) North Carolina Highway Patrol;
(3) County Health Department;
(4) County Inspections.
(G) The town may set conditions for permit approval. The applicant may be required to pay for fire/medical standby and security/law enforcement for a permit to be approved. The applicant may be required to pay additional fees if town facilities/services are being used. The town may also require the rental of portable bathrooms, lighting, trash receptacles, and/or other facilities based on the size and scope of the event.
(H) All special events must comply with any other local, state, or federal laws or regulations, including, but not limited to, the North Carolina Building Code, the National Electric Code, and ADA requirements.
(I) Any person or business that routinely has 1,000 or more persons in attendance must have a permanent special event permit issued for general operating conditions, as well as an emergency operations plan filed with the Town Manager’s office, except as provided in § 130.63. Any additional event that more than doubles the attendance shall require a new special event permit for that specific event or date, except as provided in § 130.67.
