331.36 SQUEALING TIRES, "PEELING," CRACKING EXHAUST NOISES.
   (a)   No person shall operate any motor vehicle upon any of the streets or highways or any public or private property within the City, except when necessary for safe operation or in compliance with law, in such manner that the vehicle is so rapidly accelerated, or started from a stop position or so rapidly decelerated, or stopped, that the exhaust system emits a loud, cracking or chattering noise unusual to its normal operation, or the rubber tires of such vehicle squeal, leave tire marks on the roadway or spray gravel top dressing from the roadway, commonly referred to as "peeling".

   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
