Fourteen (14) business days before the commencement of any operations preparatory to drilling for oil and gas in the City of Eastlake, any person (hereinafter referred to as Permit Holder) who has a permit issued by the State of Ohio to drill in the City of Eastlake shall:
(a) File a copy of the State issued permit with the Fire Chief, Chief Building Official, Mayor and Council office.
(b) File a letter with the Fire Chief, Chief Building Official, Mayor, and Council office containing the name, address, and telephone numbers of:
(1) The owner(s) of the subject property where the well is to be drilled, and;
(2) All drilling persons, including but not limited to the Permit Holder, who are responsible for the drilling and operation of the well.
This information provided in the letter shall be valid at its time of issuance and the telephone numbers shall be valid twenty-four (24) hours a day. “Information provided shall be updated within thirty (30) days from the date of any informational change or change in the lease assignment throughout the duration of the drilling operations and until such time as the well is capped and abandoned per Section 1521.05.
(c) Deliver a copy of the State issued permit to all owners and/or occupants of all properties that adjoin the property where a well is to be drilled, including owners and/or occupants of all properties adjoining any drilling unit or pool covered by the State issued permit.
(d) The Permit Holder shall be responsible to obtain the information as to the identity and address of the individuals to receive the notice per paragraph (c) above.
(e) The return receipt of Certified mail, signed by any person to whom the notice is delivered shall be conclusive proof of notice.
(f) File additional information below with the Fire Chief and Chief Building Official detailed in Section 1521.05 below.
