1389.04 LIABILITY OF OWNER, OCCUPANT AND OPERATOR.
   (a)   Owners, occupants and operators shall have all duties and responsibilities prescribed in this Code, individually, jointly and severally. The owner, occupant or operator agent shall monitor the frequency and adequacy of maintenance to assure on-going compliance with the provisions of this chapter.
   (b)   Any owner, occupant or operator who violates any provision of this Code commits a minor misdemeanor. Each day a violation continues constitutes a separate offense.
   (c)   Any owner, occupant or operator who violates the provisions of this Code shall be subject to a civil action in any court of competent jurisdiction to be brought by the City for any appropriate relief, including but not limited to injunction, declaratory judgment, and damages. Damages include all actual costs incurred by the City in the enforcement of this Code, including but not limited to reasonable attorney fees, administrative costs and court costs.
   (d)   Council may declare a nuisance as defined in Section 1389.03(1), and pursuant to the provisions of the Ohio Revised Code, order the abatement of such nuisance, with the actual cost being certified by the Clerk of Council to the Lake County Auditor to be charged as a tax lien.
