If Ohio R.C. 4116.01 through 4116.04, or substantially equivalent State law provisions, are found to be lawful by a court of competent jurisdiction, Sections 1375.02 and 1375.03 shall not apply to any public improvement project which includes State funds appropriated for the purposes of that public improvement.
