1347.08 RELATED TO PREMISES.
    (a)   Except as provided in subsection (b), every sign or other advertising structure as defined in this chapter shall relate directly to the business or enterprise conducted on the premises or the property on which it is situated.
   (b)   In areas of the City of Eastlake near Ohio Department of Transportation sound barriers and where such sound barrier obstruct the visibility of the business or enterprise or the signage thereof, a sign or other advertising structure may include material which does not relate directly to the business or enterprise conducted on the premises or the property on which it is situated, so long as:
      (1)   The sign or other advertising structure includes advertising for the business or enterprise conducted on the premises or the property on which it is situated.
      (2)   The sign or other advertising structure shall not advertise or display any Adult Entertainment use or any materials referenced in Section 760.02 of the Codified Ordinances of the City of Eastlake or Sexually Oriented Business or any materials referenced in Section 535.02 of the Codified Ordinances of the City of Eastlake.
      (3)   The sign or other advertising structure shall be no closer than 500 feet in any direction to any other similar sign or advertising structure.
      (4)   The sign or other advertising device shall comply with Chapter 5516 of the Ohio Revised Code and the Ohio Administrative Code promulgated thereto including but not limited to the following:
         A.   Section 5501:2-2-02(A)(3)(b)(ii) which provides that advertising devices, whether or not visible to the main-traveled way of the primary system, shall not be located within five hundred feet of an interchange or proposed interchange.
         B.   Section 5501:2-2-02(A)(3)(c)(iii) which provides that the distance from an interchange shall be measured at the nearest point of the beginning or ending of pavement widening of the exit or entrance roadway to the main traveled way along the right edge of the main traveled way of the interstate system or primary system.
      (5)   The maximum area, location and height requirements of said sign or other advertising structure shall be determined by the Chief Building Official and approved by the Safety Director. The maximum height may be restricted and required to be approved by the City of Eastlake’s Planning Commission, as ordered by the Chief Building Official.
      (6)   Said sign or other advertising structure is approved as a Conditional Use in accordance with Chapter 1161 of the Codified Ordinances of the City of Eastlake. (Ord. 2018-095. Passed 11-27-18.)
