(a) Emergency Suspension of Service and Discharge Permits. The City may, for good cause shown, suspend the wastewater treatment service and the wastewater discharge permit of a discharger when it appears to the City that an actual or threatened discharge presents or threatens an imminent or substantial danger to the health or welfare of persons, that there is substantial danger to the environment, interference with the operation of the POTW, or violation of any pretreatment limits imposed by this chapter. Any user notified of the suspension of wastewater treatment service and/or the user's wastewater discharge permit, shall within a reasonable period of time, as established by the City, cease all discharges. In the event of failure of the user to comply voluntarily with the suspension order within the specified time, the City shall commence judicial proceedings immediately thereafter to compel the discharger's compliance with such order. The City shall reinstate the wastewater discharge permit and/or the wastewater treatment service and terminate judicial proceedings pending proof by the user of the elimination of the noncomplying discharge or conditions creating the threat of imminent or substantial danger as set forth above.
(b) Revocation of Permit. The City may revoke the permit of any user which:
(1) Fails to factually report the wastewater constituents and characteristics of its discharge;
(2) Fails to report significant changes in wastewater constituents or characteristics;
(3) Refuses reasonable access to the discharger's premises by representatives of the City for the purpose of inspection or monitoring;
(4) Violates the conditions of its permit, this chapter, or any final judicial order entered with respect thereto.
(c) Notice to Abate Violation. Any user who violates any of the provisions of this chapter shall be served by the City with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the time stated in such notice, or as may be extended by the City, permanently cease all violations.
(d) Continuance of Violation. Any user who continues any violation beyond the time limit provided for herein shall be in violation of this section, and penalties shall be as provided for herein. Each day any such violation shall continue shall be deemed a separate offense. The minimum penalty shall not be suspended.
(e) Legal Action. If any person discharges sewage, industrial wastes or other wastes into the City's wastewater treatment system contrary to the provisions of this chapter, Federal or State pretreatment requirements, or any order of the City, then the Director of Law may commence an action for the appropriate legal and/or equitable relief in the Court of Common Pleas or such other court as he may determine is appropriate.
