743.02 LICENSE FEE AND CONDITIONS.
   (a)   No person shall engage in scavenging unless such person first obtains a license (the "scavenger license") from the Safety Director or his or her designated representative. The fee for a scavenger license shall be fifteen dollars ($15.00) per year. All scavenger licenses shall expire on December 31 of the year of issuance. There shall be no proration of the fee for a scavenger license issued after the start of a calendar year.
   (b)   A condition of any scavenger license issued shall be that the licensee agrees to scavenge between the hours of 7:00 a.m. and 9:00 p.m. and to collect, transport and dispose of trash in a sanitary manner so as not to create a nuisance and to comply with all rules and regulations from time to time promulgated by the Safety Director, which may include but not be limited to, times and days for collections and designation of areas.
   (c)   Before a vehicle may be used in scavenging, the holder of the scavenger license shall register such vehicle with the office of the Safety Director.
   (d)   Any person issued a scavenger license shall display a copy of the license in prominent sight on each vehicle used by such person in scavenging identifying such person as a licensed scavenger and containing current contact information for such person.
   (e)   Any vehicle conveying or carrying trash shall be so constructed and operated that its contents shall not spill or scatter upon any public or private property. Any person hauling or scavenging trash in or using an open vehicle such as a truck or trailer shall cause the load to be covered with an adequate tarpaulin or canvas so as to prevent any spilling or scattering of its contents.
   (f)   After a person engaged in scavenging inspects and/or removes items of trash, such person shall clean up any debris resulting from such person's activities, return any uncollected trash to the bags or containers from which they were removed and return the remaining trash to the condition existing prior to such inspection and/or collection.
   (g)   No person shall remove or cause the removal of recyclable materials from any lot, premises or public place that have been placed or deposited for collection by the City or the City trash collector.
   (h)   This section shall not apply to:
      (1)   Any private individual removing or hauling trash from his or her own premises;
      (2)   Any City employee within the performance of his duties with the City;
      (3)   The City trash collector;
      (4)   Any private or public school.
