§ 50.064 RESTRICTIONS ON AMENDMENTS.
   This subchapter shall not be amended without the permission of the holders of a majority (in amount) of outstanding bonds issued by the city, plus the permission of the Farmers Home Administration, United States Department of Agriculture, so long as the United States is the owner or insurer of any bonds issued by the city and so long as any of the bonds remain unpaid.

WATER AND SEWER RATES AND CHARGES
§ 50.080 WATER AND SEWER RATES.
   (A)   Generally. The rates and charges for water and sewer services furnished by the city are hereby fixed and established on a monthly basis as follows.
   (B)   Specifically.
      (1)   Minimum water rates.
         (a)   Minimum water rates for citizens of the city.
            1.   The following minimum monthly charges shall apply to the first 1,000 gallons (or less) of water used by the premises and classifications respectively designated below:

            2.   The rates for water usage for the premises and classifications as to water usage in excess of the first 1,000 gallons shall be identical with the rates for the additional usage specified in division (B)(2) below.
         (b)   Minimum water rates for customers outside the city limits.
            1.   The following minimum monthly charges shall apply to the first 1,000 gallons (or less) of water used by the premises and classifications respectively designated below:

            2.   The rates for water usage for the premises and classifications as to water usage in excess of the first 1,000 shall be identical with the rates for the additional usage specified in division (B)(2) below.
      (2)   Meter rates for water usage in addition to minimum charge.
         (a)   Inside the city. Subject to the respective minimum monthly water rates specified above, the following metered charges shall be made for each 1,000 gallons of water consumption per month to customers residing in the city of all size connections:

      (3)   Monthly sewer rates. The rates or charges for sewer service shall be based insofar as possible upon the quantity of water supplied each month to the respective premises and shall be $21 per first 1,000 gallons of water used as set forth on the monthly water bill determined by the above water rates. After the first 1,000 gallons of water used, the charge will be $7 per 1,000 gallons. The minimum sewer bill shall be $21 per month, apart from the surcharge referred to in the ensuing division (B)(4) below.
      (4)   Surcharge for sewage collection. In the event there is a rate increase from the City of Madisonville or the South Hopkins Water District to the City of Earlington for their services, any rate increase by the City of Madisonville or the South Hopkins Water District shall automatically be passed on in the same proportion to the customers of the City of Earlington’s water services.
      (5)   Rates are exclusive of sales tax. The foregoing rates are rates to be charged by the city, and any applicable state sales tax shall be added to each bill as a separate charge.

§ 50.081 WATER AND SEWER CONNECTION CHARGES.
   Where laterals are available, the water works connection charge shall continue to be $250 for all size connections, and the sewer connection charge shall continue to be $500 for all size connections. Where laterals are not available, the connection charges for either water or sewer connections shall be based on the time and material expended in making the connection, and shall include a 10% administrative cost.

§ 50.082 BILLING AND COLLECTION PROCEDURES.
   (A)   Generally. The Water and Sewer Department of the city will implement the following billing procedures.
   (B)   Specifically.
      (1)   Meter readings; records.
         (a)   The geographic distribution area for water and sewer customers of the system will be divided into eight routes, using city streets as route boundaries.
         (b)   A route ledger will be maintained for each route, bearing the appropriate number (one through eight) to correspond with the route for which the ledger is maintained. A subsidiary ledger meter card for each service location, designed to cover a two-year period, shall also be maintained, and the subsidiary ledger meter cards shall be arranged and filed in the order of the reading of meters in the respective route. Provision shall be made on the cards for the recording of service on a fiscal year basis, ending on June 30 of each year, to coincide with the city's fiscal year. When a meter is read, the reading for the current month shall be recorded, and furnished to the accounting clerk, who shall subtract the previous month's reading from the current month's reading to compute the water usage for billing purposes.
      (2)   Collection policy. If a bill is not paid within 15 days following the end of the billing cycle applicable to the bill, the bill shall be considered delinquent, and there shall be imposed a penalty on each bill not so paid, in an amount equal to 10% of the charges (other than sales tax) shown on the face amount of the delinquent bill. If the bill is not paid within 30 days following the end of the applicable billing cycle, the water service of the customer will be disconnected as set forth in §§ 50.100 through 50.103.

§ 50.083 DISCONNECTIONS AND RECONNECTIONS; SERVICE CHARGE.
   When service is disconnected or reconnected to the premises of any customer for the convenience of the customer, a service charge of $10 shall be made, if the disconnection or reconnection is made during regular working hours. If the disconnection or reconnection, for the convenience of any customer, is made at night after regular working hours, or on a Sunday or a legal holiday, the service charge shall be $25.
