12-422: PRELIMINARY PLAT:
   A.   Based upon the approval of the sketch plat, the landowner, or his representative, may file an application for approval of a preliminary plat. The application shall:
      1.   Be made on forms available at the office of the administrative officer of the planning commission;
      2.   Include all land which the applicant proposes to subdivide, provided that the planning commission shall not require a preliminary plat for an area in excess of eighty (80) acres;
      3.   Be accompanied by a minimum of four (4) copies of the preliminary plat as described in these regulations; and
      4.   Comply in all respects with the sketch plat as approved.
   B.   Upon receipt of an application for preliminary plat approval, the administrative officer shall:
      1.   Set a hearing date for planning commission's review of the preliminary plat; and
      2.   Notify all adjacent property owners and the subdivider as required for sketch plat approval.
   C.   In order to minimize the duplication of platting work, the planning commission may accept a development plan in lieu of a preliminary plat. Such substitution shall be permitted only in those instances where the development plan contains all information required on a preliminary plat.
   D.   The planning commission shall consider the preliminary plat at the scheduled hearing, and any adjourned date thereof, and shall approve, conditionally approve, or disapprove the preliminary plat within sixty (60) days of the official submission date, unless continuance is agreed upon by the subdivider. If the preliminary plat is conditionally approved or disapproved, the reasons for such action shall be stated in writing and signed by the planning commission chairman and attached to a copy of the plat and transmitted to the subdivider.
   E.   The approval of a preliminary plat shall not be subject to any termination date provided that any plat undeveloped for a period of more than three (3) years from the date of preliminary plat approval shall be reviewed for compliance with subsequent amendments to the ordinances and resolutions governing the subdivision and use of land as specified in section 12-406 of this chapter.
   F.   Prior to approval of a final plat the planning commission may permit the preliminary plat to be divided into two (2) or more sections and may impose such conditions upon filing of the final plat sections as it may deem necessary to assure the orderly development of the plat.
